The UPDES Permit granted the City of Orem a compliance schedule to meet the Technology-Based Phosphorus Effluent Limit (TBPEL) Rule, Utah Administrative Code (UAC) R317-1-3.3. The Permittee received an initial variance to the TBPEL Rule before it went into effect in 2020, allowing until January 1, 2023. Due to construction delays, a compliance schedule was incorporated. The permittee requested an extension of the compliance schedule on November 12, 2024. As part of the variance, the Facility was required to meet an interim annual average effluent total phosphorus(TP) of 2.5 mg/L between January 1, 2020, and December 31, 2024. The Facility upgrades were set to be complete in fourth quarter 2024. However, due to construction delays and other unforeseen circumstances, the final completion date will now be sometime in 2025. As a result, the permittee has requested an extension of thecompliance schedule for the total TP limit required by the TBPEL Rule. The Division of Water Quality has granted this request, as the construction delays were out of the Permittee’s control. As a result, the TBPEL Rule compliance date is now being moved to January 1, 2026, with an interim annual average TP limit of 2.5 mg/L. The below permit limits and Compliance Schedule are also reflected in Part I.C.2. and Part I.C.3.of UPDES Permit No. UT0020915. All other parameters in the permit will remain unchanged. During the public comment period provided under R317-8-6.5, any interested person may submit written comments on the draft permit and may request a public hearing, if no hearing has already been scheduled. A request for a public hearing shall be in writing and shall state the nature of the issues proposed to be raised in the hearing. All comments will be considered in making the final decision and shall be answered as provided in R317-8-6.12.ADDENDUM TO FSSOBDuring finalization of the Permit certain dates, spelling edits and minor language corrections were completed.
