PUBLIC NOTICE TOREISSUE THEGENERAL PERMIT FOR
CONCENTRATED ANIMAL FEEDING OPERATIONS
PURPOSE OF PUBLIC NOTICE
The purpose of this public notice is to declare the state of Utah’s intention to issue a Utah Pollutant Discharge Elimination System (UPDES) permit under authority of the Utah Water
Quality Act, Utah Code §§19-5-104 and 107, as amended.

BACKGROUND
The Federal Clean Water Act (CWA) requires permit coverage for discharges from Concentrated Animal Feeding Operations underindividual or general CAFO permits(See 40CFR §122.23(d)(1).The
United States Environmental Protection Agency Region VIII, has delegated the Utah Division of Water Quality (DWQ) to implement the CWA in the state of Utah.At this time, DWQ is preparing
to issue the UPDES General CAFO Permit to implement both CAFO requirements in the CWA and CAFO permit requirements in Utah Admin. Code R317-8-10.
The UPDES CAFO General Permit is issued for a five-year term. The current permit was issued on December 17, 2019, and is set to terminate on December 16, 2024. Please refer to the
Fact Sheet and Statement of Basis of the proposed CAFO permit included in this public notice for the proposed changes to the current CAFO permit. PUBLIC COMMENTS
The CWA and Utah Admin. Code R317-8-6.5requirethat proposed CAFO permits be public noticed for public comment and revision, if needed, prior to issuance of the final permit.Public comments
on the CAFO permit are invited any time prior to the deadline of the close of business on December 16, 2024.
During the public comment period,any interested person may submit written comments on the proposed CAFO permit and may request a public hearing if no hearing has already been scheduled.
A request for a public hearing shall be in writing and shall state the nature of the issues proposed to be raised in the hearing. All comments will be considered in making the final
decision and shall be answered as provided in Utah Admin. Code R317-8-6.12.

After considering public comment, the Director may execute the proposed permit, revise it, or abandon it. The permit and associated documents are available for public review under “Public
