Divisionof Water Qualityunder authorityoftheUtahWaterQualityAct,Section19-5-106(g)UtahCodeAnn. 1953,asamendedandUtahAdministrativeCodeR317-6.UnderSection19-1-301.5,effectiveMay8,2012,a
personwhowishestochallengeaPermitOrdermayonlyraiseanissueorargumentduringanadjudicatory proceeding that was raised during the public comment period andwassupportedwithsufficientinformationor

Peak Minerals Inc. is proposing to construct potash (potassiumsulfate)miningoperationsandfacilities ontheSevierPlayalocatedinMillardCounty,Utahapproximately30milessouthwestofDelta. The
original permit was issued to Crystal Peak Minerals, but construction never began due to economic conditions. Thepotash miningareawillbetheentireSevierPlayasurface(approximately26mileslongandupto8mileswide),with
productionpondsandfacilitieslocatedatthesouthendoftheplaya.TheProjectwillbedesignedtoproduce approximately215,000tonsofpotash,aswellasotherassociatedminerals,peryear.GroundwaterDischarge
PermitNo. UGW270012isbeingissuedtoestablishrequirementsforpondconstructionplans,specifications, facilityoperation and monitoring, and closureproceduresforactivitiesatthesitethathavethepotentialto
impactgroundwater.ThegroundwaterqualitybeneaththesiteisconsideredClassIVSalineGroundWater unless site-specific data is collected at the site to determine another classification.
