Storage (continue) Used oil containers and aboveground tanks:•Secondary containment system (pipes and valves):•Dikes, berms, or retaining walls; and•A floor.•Sufficiently impervious (material).•Of sufficient extent (size). Storage (continue) Used oil containers and aboveground tanks:•Remove water, used oil beyond surface sheen, liquids from secondary containment/sumps within 24 hours of discovery.•Do not allow used oil to be stored/accumulate in sumps/water containment structures. Used oil rail tanker cars:•Comply with secondary containment requirements for transferring used oil to or from rail cars. Generators may transport without an EPA identification number, a used oil transporter permit, and a current used oil handler certificate, used oil that is: Shipping (continue) Generators may transport without…•Generated at the generator’s site.•Collected from household do-it- yourselfers.•Transported to a UOCC.•In a vehicle owned by the generator or by an employee.•Transporting ≤55 gallons at any time.•Transported to a registered UOCC or aggregation point owned by the generator. Shipping (continue) Tolling arrangements:•If the used oil is reclaimed under a contractual agreement under which reclaimed oil is returned by the processor/re-refiner to the generator for use as a lubricant, cutting oil, or coolant, in the generator’s transportation vehicle. Shipping (continue) Used oil transporters shall deliver all used oil received to a permitted:•Used oil transporter;•Used oil processing/re-refining facility;•Off-specification used oil burner facility;•Used oil transfer facility; or•An on-specification used oil burner facility. Shipping (continue) DOT requirements:•Used oil transporters shall comply with all applicable requirements under the U.S. Department of Transportation regulations in 49 CFR 171 through 180.•Persons transporting used oil that meets the definition of a hazardous material in 49 CFR 171.8 shall comply with all applicable regulations in 49 CFR 171 through 180. Shipping (continue) Used oil discharges:•In the event of a used oil discharge, a transporter shall comply with the Emergency Controls requirements.•Immediate action.•Emergency control variance.•Release cleanup.•Reporting. Shipping (continue) Labeling:•Bulk transportation:•Mark all vehicles with the words "Used Oil“ (both sides);•Clearly visible;•In letters at least two inches high. •Non-bulk transportation:•Label individual containers with the words “used Oil.” Shipping (continue) Acceptance:•Keep a written record of each used oil shipment accepted for transport.•Can be a log, invoice, manifest, bill of lading, or other shipping documents. Tracking Acceptance: Written records for each shipment* shall include:•Name and address of “generator” and the transporter;•EPA identification number of generator and transporter;•Documentation demonstrating halogen, PCB, Non-hazardous (rebuttable presumption) determination; Tracking (continue) Acceptance: Written records for each shipment* shall include:•Quantity accepted;•Date of acceptance; and•Signature (Not for intermediate rail transporters).•Acceptance of off-site used oil: *Delivered by permitted transporters with a current EPA identification number. Tracking (continue) Annual Reporting (Transporters and permitted facilities):•Submit annually by March 1 to the Director.•Consistent with the registration and permitting of used oil handlers' requirements (R315-15-13).•May use Annual report form (combined) Notification EPA Identification numbers (Transporters and permitted facilities):•Comply with the notification requirements of RCRA section 3010 and obtain an EPA identification number by submitting either:•A completed EPA Form 8700- 12; or•A letter to the Division requesting an EPA ID number. Notices Certification (Off-specification burner): Before accepting the first shipment of off-specification used oil fuel, the burner shall provide a one-time written and signed notice certifying that:•The Director has been notified of location and general description of management activities. Certification (Off-specification burner): Before accepting the first shipment… •The off-specification used oil will be burned only in an industrial furnace or boiler identified in R315-15-6.2(a). Notices (continue) Certification (Fuel marketer): Before directing the first shipment of off-specification used oil fuel to a burner, it shall obtain a one-time written and signed notice from the burner certifying that:•The Director has been notified of the location and general description of used oil management activities. Notices (continue) Certification (Fuel marketer): Before directing the first shipment…•Has obtained an EPA identification number.•Is permitted as an off-specification used oil burner (Utah).•The off-specification used oil will be burned only in an industrial furnace or boiler identified in R315-15-6.2(a). Notices (continue) Certification retention: Maintained at the permitted facility or other location approved by the Director, for three years from:•The date the burner last receives shipment of off- specification used oil.•The date the last shipment of off-specification used oil is shipped to the burner.
