October 2024 EMERGENCY CONTROLS 9.1 Immediate Action R315-15-9 If necessary, repair or replace any leaking used oil tanks, containers, and ancillary equipment Clean up and manage properly the released material Contain the release Stop the release Take appropriate action to minimize the threat to human health & the environment EMERGENCY CONTROLS R315-15-9 EMERGENCY CONTROLS 9.1 Immediate Action (cont.) R315-15-9 Small leaks and drips from vehicles are considered de minimis and not subject to R315-15-9 Smaller releases that pose a potential threat to human health or the environment Spills exceeding 25 gallons, or Notify UDEQ 24-hour Answering Service 801-536-4123 EMERGENCY CONTROLS 9.1 Immediate Action (cont.) R315-15-9 Name, phone number, and address of person responsible for release Name, title, and phone number of individual reporting Time and date of release Location of release Description contained on manifest and amount released Cause of release Possible hazards to human health/environment and emergency actions taken Extent of any injuries Provide the following information when reporting the release: EMERGENCY CONTROLS 9.2 Emergency Control Variance R315-15-9 Determined by the Director Granted until the release no longer presents an immediate hazard to human health/environment EPA Identification Number Used Oil Handler’s certificate Used Oil Transporter permit Applies to the following requirements: Granted by the Director Variance for situations where immediate action is required EMERGENCY CONTROLS 9.3 Release Clean Up R315-15-9 The clean up or other required actions shall be at the expense of the person responsible for the release May be required to meet US EPA Regional Screening Levels Shall clean up the released material/residue/contaminated media The person responsible for the material at the time of the release: EMERGENCY CONTROLS R315-15-9 EMERGENCY CONTROLS 9.4 Reporting R315-15-9 Within 15 days after the release, the person responsible for the material at the time of the release shall submit a written report to the Director containing: the person's name, address, and telephone number date, time, location, and nature of the incident name and quantity of materials involved the extent of injuries, if any an assessment of actual or potential hazards to human health or the environment the estimated quantity and disposition of recovered material that resulted from the incident STANDARDS FOR THE DISPOSAL OF USED OIL R315-15-8 STANDARDS FOR THE DISPOSAL OF USED OIL 8.1 Applicability Used oils that cannot be recycled and are therefore being disposed R315-15-8 STANDARDS FOR THE DISPOSAL OF USED OIL 8.2 Disposal Determine if the used oil is a hazardous waste (listed/characteristic) R315-15-8 Hazardous: R315-260, 266, 268, 270 and 273 Nonhazardous: Disposed in a solid waste disposal facility meeting R315-301 though 318 STANDARDS FOR THE DISPOSAL OF USED OIL R315-15-8 STANDARDS FOR THE DISPOSAL OF USED OIL 8.3 Use as a Dust Suppressant, Weed Suppressant, or for Road Oiling R315-15-8 Prohibited MANAGEMENT OF RESIDUES R315-15-1.1(e) MANAGEMENT OF RESIDUES 1.1(e) Materials derived from used oil R315-15-1.1(e) Materials that are reclaimed from used oil and used beneficially and not burned or used in a manner constituting disposal Not used oil Not solid waste MANAGEMENT OF RESIDUES 1.1(e) Materials derived from used oil Materials that are produced from used oil and burned for energy recovery R315-15-1.1(e) Subject to R315-15 and regulated as used oil MANAGEMENT OF RESIDUES 1.1(e) Materials derived from used oil Materials that are derived from used oil and disposed of or used in a manner constituting disposal R315-15-1.1(e) Not used oil Are solid wastes and subject to hazardous waste regulations if listed or characteristic MANAGEMENT OF RESIDUES 1.1(e) Materials derived from used oil Used oil re-refining distillation bottoms that are used as feedstock to manufacture asphalt products R315-15-1.1(e) Not subject to R315-15 QUESTIONS?
