HomeMy WebLinkAboutDERR-2024-011672PUBLIC NOTICE of COMPLETION Five-Year Review for the Midvale Slag Superfund Site Salt Lake County, Utah Summary: Fifth Five-Year Review Completed The Utah Department of Environmental Quality, Division of Environmental Response and Remediation (UDEQ/DERR), and the U.S. Environmental Protection Agency (EPA), Region 8, have completed the fifth Five-Year Review for the Midvale Slag Superfund Site (Site). Five-Year Reviews are required by the Comprehensive Environmental Response, Compensation and Liability Act (CERCLA) when hazardous substances remain on site above levels that permit unrestricted use and unlimited exposure. Five-Year Reviews are conducted to evaluate the site remedy and to determine whether site conditions remain protective of human health and the environment. Report Summary and Protectiveness Statement: This review provides the assessment of cleanup remedies at Operable Units (OU) 1 and 2. OU1 encompasses the portion of the Site north of the former slag piles and smelter complex area and includes the Winchester Estates residential area. OU2 encompasses the former slag piles and smelter complex area. The review concludes the remedies at OU1 and OU2 are functioning as intended however additional actions are necessary to ensure long- term protectiveness. On January 17, 2024, the EPA issued “Updated Residential Soil Lead Guidance for CERCLA sites and Resource Conservation and Recovery Act (RCRA) Corrective Action Facilities” that lowered recommended regional screening level (RSL) for lead-contaminated soil at residential areas. The EPA and UDEQ/DERR will evaluate how this change may impact the cleanup that was conducted at the Site and determine if additional investigation and/or cleanup is needed. The EPA and UDEQ/DERR will share information on planned activities and results as they become available. A protectiveness determination of the remedy at the Midvale Slag site cannot be made at this time and is deferred until further information is obtained. Additional response actions may be necessary for the remedy to remain protective. It is expected that determination of the protectiveness status at the Site could take approximately 36 months to complete. This Five-Year Review Report was signed April 8, 2024 and the next Five-Year Review is required five years from the completion date.
