An UST is a tank system, including piping connected to the tank, that has at least 10 percent of its volume underground. Federal and state regulations apply only to those USTs containing petroleum products or certain hazardous chemicals. USTs that are not regulated by the DERR: • Farm or residential tanks 1,100 gallons or less, used non-commercially. • Tanks storing heating oil used on the premises. • Flow-through process tanks. • Emergency spill and overflow tanks. • Tanks holding 110 gallons or less. • Tanks containing hazardous waste. Certification Requirements A person must have the limited Installer Certification (Service/Repair Technician) if they work on any portion of the UST system that is critical to the integrity of the system. Training For initial certification, an applicant must have successfully completed an underground storage tank installer training course or equivalent within the six-month period prior to the application. The training course shall be approved by the Executive Secretary. The applicant must provide documentation of training with the application. Utah Admin. Code R311-201. Experience Each applicant for the Service/Repair Technician Certification must provide documentation of training and experience in the type of equipment they will be servicing or repairing. This may include manufacturers certification/training when working with complex systems such as ATGs. Certification An applicant must successfully pass a certification examination administered under the direction of the Executive Secretary. The Executive Secretary shall determine the content of the initial and renewal examinations, based on the training requirements as outlined in Subsection R311-201, and the standards and criteria against which the applicant will be evaluated. The Executive Secretary may offer a renewal certification examination that is less comprehensive than the initial certification examination. Utah Admin. Code R311-201. Examination An applicant must successfully pass a certification examination. Examinations are given at the DERR office. Application Initial Certification Requirements: • All applicable fees must be paid prior to certification. • Submit application. • Proof of citizenship. • Proof of training. Renewal Requirements: • Renew every 2 years. • Application and fees. • Pass the certification examination. Reciprocity If the Division Director determines that another state’s certification program is equivalent to the certification program provided in R31-201, they may issue a Utah certification. The application, certification fees, and citizenship requirements still apply. Certified Technician Standards of Performance The certified technician: • Must display the certificate upon request. • Must comply with all local, state, and federal laws and regulations regarding USTs. • Must report the discovery of any release caused by or encountered in the course of performing tank handling to the local health district, local public safety office and the DERR within twenty-four hours. • Must not participate in fraudulent, unethical, deceitful or dishonest activity with respect to USTs. • Must not participate in any other regulated certification program activities without meeting all requirements of that certification program. NOTE: For violations of the standards of performance as outlined in R311-201 a sampler could be fined civil penalties of up to $10,000 per violation per day. See R311-201-6. Service/Repair Technician A person must have the Installer/Technician endorsement if they work on any portion of the UST system that is critical to the integrity of the system, which include: (the following do not require a permit) • Line Leak Detectors. • Repairs on any portion of the UST system. • Automatic Tank Gauging (ATG) • Probes/Sensors. • Overfill and spill devices. • Containment and transition sumps • Sub-pumps • Relays and electrical components Things that require a UST permit include, and therefore require the supervision of a certified UST Installer: • New installation of tanks or piping • Repair or replacement of tanks • Repair or replacement of piping Technician Responsibilities • All work performed on a UST system which regularly contains product must be tested after the work is completed. For example: If you repair or replace a line leak detector, the leak detector and the line must be tested for tightness. If you work on a spill bucket, the bucket must be tested. • As a technician if you come across any contamination or discover an unusual operating condition, you should inform the owner and the DERR should be contacted within 24 hours to report a suspected release. Examples may be: • Product in a sump • Alarms • Damaged equipment such as holes in a spill bucket or sump • Release detection equipment not operating properly Certification Not Required to Perform the Following: • Replace dispenser filters • Replace or repair dispenser hoses • Repairs on any portion of the dispenser • Clean spill buckets • Clean up small spills (<25 gallons)
