SUBJECT: PROPOSE FOR PUBLIC COMMENT: Amend R307-315. NOx Emission Controls for
Natural Gas-Fired Boilers 2.0-5.0 MMBtu.

On August 3, 2018, the U.S. Environmental Protection Agency (EPA) designated Utah’s Northern Wasatch
Front (NWF) as a marginal nonattainment area (NAA) for the 2015 National Ambient Air Quality Standard
for 8-hour ozone concentrations (83 FR 25776). On October 7, 2022, EPA finalized the reclassification of
the NWF NAA from marginal to moderate status (87 FR 60897) because the area failed to attain the
standard by the attainment date. Monitoring data from 2021 through 2023 indicate that the area will not
attain the standard under the moderate timeline, and will be reclassified to serious nonattainment status in
early 2025.
As a result of these designations, the state of Utah is required to identify and implement reductions of
ozone precursor emissions, including volatile organic compounds (VOCs) and oxides of nitrogen (NOx), in
the NAA as part of its State Implementation Plan (SIP) obligations under section 172(c)(2) of the Clean Air
Act. On May 3, 2023, the Utah Air Quality Board adopted R307-315, NOx Emission Controls for Natural
Gas-Fired Boilers 2.0-5.0 MMBtu, as part of these efforts. Rule R307-315 reduces NOx emissions from
industrial, commercial, and institutional natural gas-fired boilers in Salt Lake, Weber, Davis, Tooele, and
Utah counties by requiring that any new boiler, or burner installed on a boiler, in these areas be certified to
emit no more than nine parts per million by volume (ppmv) of NOx while operating. These rules do not
require retrofits or replacements of any existing boilers and are only required for boilers operating on
pipeline quality natural gas, and thus do not apply to facilities which operate boilers using plant gas such as
refining operations.

As a result of feedback received from discussion by the Utah Air Quality Board during the final adoption
of R307-315, conversations with boiler manufacturers and distributors, as well as feedback from sources as
they work towards the initial implementation date, the Utah Division of Air Quality is proposing the
following minor amendments to R307-315:
1) Moving applicability language originally located in Section R307-315-4 to Section R307-315-2;
2) a carbon monoxide (CO) limit of 200 ppmv has been added;
3) a definition of “combustion analysis” was added; and
4) the definitions of “construction” and “modification” were modified.
These amendments are proposed in efforts to:
1) Clarify the applicability of the rule while making it easier to read;
2) provide additional mechanisms to verify compliance with the rule;
3) provide clarity for how compliance with the rule can be achieved; and
4) bring definitions in line with the intent of the rule while simultaneously making these definitions
more consistent with those found elsewhere in state and federal rules.
The division anticipates that a 30-day public comment period for the proposed amendments would run
from May 15, 2024, to June 14, 2024. This timeline would give stakeholders a total of 45 days from
proposal to close of the public comment period to review the proposed amendments and provide comment
to the division.
Recommendation: Staff recommends the Board approve amendments to R307-315, NOx Emission
Controls for Natural Gas-Fired Boilers 2.0-5.0 MMBtu, for a 30-day public comment period.

The proposed amendments modify and add additional definitions and language intended to clarify compliance and applicability
of rule R307-315. These amendments: 1) add a carbon monoxide limit which provides clarity for compliance with the rule, 2)
adds in the definition of “combustion analysis” to provide additional guidance for compliance, 3) modifies the definitions of
“modification” and “construction” to clarify the intent of the rule, the applicability of the rule, and makes these definitions more
consistent with federal definitions, and 4) moves applicability language from Subsection R307-315-4 to the applicability
Subsection in R307-315-2 to provide additional clarity for when the rule is applicable.

A) State budget:
There are no anticipated costs or savings to the state budget as the amendments will have no impact on how the Division of Air
Quality functions. The proposed amendments provide additional clarity around applicability and compliance with the rule;
however, do not expand the applicability beyond the original intent of the rule. Therefore, the changes do not result in any costs
or savings beyond those identified with the original adoption of rule R307-315, nor do the changes to the rule result in any
functional changes to how the Division implements the rule.
B) Local governments:
There are no anticipated costs or savings to local governments associated with the amendments. The proposed amendments
provide additional clarity around applicability and compliance with the rule; however, do not expand the applicability beyond the
original intent of the rule. Therefore, the changes do not result in any costs or savings beyond those identified with the original

R307-315-1. Purpose. 3
Rule R307-315 establishes maximum emission thresholds for the emissions of oxides of nitrogen 4
(NOx) and carbon monoxide (CO) for new or modified natural gas-fired boilers with a total rated heat 5
input of at least 2.0 million British Thermal Units per hour (MMBtu/hr) and not more than 5.0 6
MMBtu/hr. 7

R307-315-2. Applicability. 9
(1) Rule R307-315 applies to each boiler that[ begins construction or modification after the10
compliance date defined in Section R307-315-6 that]: 11
(a) is fueled exclusively by natural gas;12
(b) has a total rated heat input greater than 2.0 MMBtu/hr and not more than 5.0 MMBtu/hr;13
(c) is an industrial boiler, institutional boiler, or commercial boiler;14
(d) is located in Salt Lake, Utah, Davis, Weber, or Tooele County; and15
(e) [is not a temporary boiler.]undergoes one of the following after the compliance date defined16
in Subsection R307-315-6(3): 17
(i) begins construction, or modification of a boiler;18
(ii) replaces a burner in a boiler having only a single burner; or19
(iii) replaces 50% or more of the burners in a multi-burner boiler.20
(2) Exemptions to this rule include:21
(a) residential boilers as defined in this rule;22
(b) CO boilers as defined in this rule;23
(c) waste heat boilers as defined by this rule;[ and]24
(d) process heaters as defined by this rule[.]; and25
(e) temporary boilers as defined by this rule.26

R307-315-3. Definitions. 28
As used in this rule: 29
"Boiler" means an enclosed device using controlled flame combustion of natural gas, as defined 30
by this rule, in which water is heated to recover thermal energy in the form of steam or hot water. 31
Controlled flame combustion refers to a steady-state, or near steady-state, process wherein fuel or 32
oxidizer feed rates are controlled. 33
"Burner" means the functional component of a boiler that provides the heat input by combustion 34
of a fossil fuel, with air or oxygen. Burners are available either as part of the boiler package from the 35
manufacturer, as stand-alone products for custom installations, or as replacement products. 36
"CO boiler" means a boiler that is fired with gaseous fuel with an integral waste heat recovery 37
system used to oxidize CO-rich waste gases generated by a Fluid Catalytic Cracking Unit. 38
“Combustion analysis” means an analysis performed on flue gases using a portable instrument 39
which measures a range of variables relevant to the byproducts of combustion including temperatures, 40
draft pressure, concentrations of oxygen, and concentrations of pollutants. 41
"Commercial boiler" means a boiler used in commercial establishments such as hotels, 42
restaurants, and laundries to provide electricity, steam, or hot water. 43
"Construction" means any physical change or change in method of operation including 44
fabrication, erection, installation, demolition, or modification of an emission unit [boiler which] that 45
would result in a[n] potential increase in [actual NOx ]emissions. 46
"Industrial boiler" means a boiler used in manufacturing, processing, mining, and refining or any 47
other industry to provide steam, hot water, or electricity. 48
"Institutional boiler" means a boiler used in institutional establishments such as medical centers, 49
nursing homes, research centers, institutions of higher education, elementary and secondary schools, 50
libraries, religious establishments, and governmental buildings to provide electricity, steam, or hot water. 51
"Modification" means any planned change in a [boiler]source which results in a[n increase of 52
actual NOx] change in emissions. 53
"Natural gas" means: 54

(1) a mixture of gaseous hydrocarbons, with at least 80% methane by volume, and of pipeline1
quality, such as the gas sold or distributed by any utility company regulated by the Utah Division of 2
Public Utilities; 3
(2) liquefied petroleum gas, as defined by the American Society for Testing and Materials in4
ASTM D1835, or propane, propane-derived synthetic natural gas, or mixtures thereof; or 5
(3) propane or propane-derived synthetic natural gas.6
"Process Heater" means an enclosed device using controlled flame, and the unit's primary purpose7
is to transfer heat indirectly to a process material such as liquid, gas, or solid, or to a heat transfer material 8
such as glycol or a mixture of glycol and water, for use in a process unit, instead of generating steam. 9
Process heaters are devices in which the combustion gases do not come into direct contact with process 10
materials. Process heaters include units that heat water and water mixtures for pool heating, sidewalk 11
heating, cooling tower water heating, power washing, or oil heating. 12
"Propane" means a colorless gas derived from petroleum and natural gas, with the molecular 13
structure C3H8. 14
"Residential boiler" means a boiler used to provide heat or hot water or as part of a residential 15
combined heat and power system. This definition includes boilers located at an institutional facility such 16
as a university campus, military base, church grounds, or a commercial, or industrial, such as a farm, used 17
primarily to provide heat or hot water for: 18
(1) a dwelling containing four or fewer families; or19
(2) a single unit residence dwelling that has since been converted or sub-divided into20
condominiums or apartments. 21
"Temporary boiler" means any gaseous or liquid fuel-fired steam generating unit that is designed 22
to, and is capable of, being carried or moved from one location to another by wheels, skids, carrying 23
handles, dollies, trailers, or platforms. A steam generating unit is not a temporary boiler if any one of the 24
following conditions exists: 25
(1) the equipment is attached to a foundation;26
(2) the steam generating unit or a replacement remains at a location for more than 18027
consecutive days and any temporary boiler that replaces a temporary boiler at a location and performs the 28
same or similar function shall be included in calculating the consecutive time period; 29
(3) the equipment is located at a seasonal facility and operates during the full annual operating30
period of the seasonal facility, remains at the facility for at least two years, and operates at that facility for 31
at least three months each year; or 32
(4) the equipment is moved from one location to another in an attempt to circumvent the33
residence time requirements of this definition. 34
"Waste heat boiler" means a device that recovers normally unused energy such as hot exhaust gas 35
and converts it to usable heat. Waste heat boilers are also referred to as heat recovery steam generators. 36
Waste heat boilers are heat exchangers generating steam from incoming hot exhaust gas from an 37
industrial or power equipment such as thermal oxidizers, kilns, furnaces, combustion turbines, and 38
engines. Duct burners are sometimes used to increase the temperature of the incoming hot exhaust gas. 39

R307-315-4. Requirements. 41
(1) An [person ]owner or operator of a boiler subject to this rule shall[ that]:42
[ (a) begins construction, or modification of a boiler;43
(b) replaces a burner in a boiler having only a single burner; or44
(c) replaces 50% or more of the burners in a multi-burner boiler for a boiler meeting the45
requirements of Section R307-315-2 shall install a burner that meets a NOx emission rate of nine parts per 46
million by volume (ppmv) or less at 3% volume stack gas oxygen on a dry basis.] 47
(a) install a burner that meets a NOx emission rate of nine parts per million by volume (ppmv) or48
less at 3% volume stack gas oxygen on a dry basis; and 49
(b) meet a CO emission rate of 200 ppmv or less at 3% volume stack gas oxygen on a dry basis.50
(2) An owner or operator of a boiler subject to Subsection R307-315-4(1) shall:51
(a) operate and maintain the boiler and boiler subsystems, including burners, according to the52
manufacturer's instructions; 53
(b) determine continued compliance based on Section R307-315-6; and54

(c)meet the applicable recordkeeping requirements for any control device.1

R307-315-5. Recordkeeping. 3
(1) The owner or operator of any boiler subject to [Rule]Section R307-315-4 shall:4
(a) retain documentation of the unit's emission rate specifications;5
(b) retain a copy of the manufacturer's recommendations for proper operation and maintenance6
of units covered by Rule R307-315; and 7
(c)maintain records showing proper operation and maintenance of units covered by Rule R307-8
315 following manufacturer's recommendations. 9
(2) Operation and maintenance records shall be retained for five years and shall be made10
available to the director upon request. 11

R307-315-6. Compliance Schedule. 13
(1) Compliance with the NOx emission requirement listed in Subsection R307-315-4(1)(c) shall14
be determined according to the following procedures: 15
(a) U.S. EPA Reference Method 7E, Determination of Nitrogen Oxides Emissions from16
Stationary Sources; 17
(b) other EPA-approved testing methods acceptable to the Director; or18
(c) combustion analysis as part of a regular maintenance schedule.19
(2) Compliance Determination shall be conducted once every five years.20
(3) The compliance schedule for this rule shall begin on May 1, 2024.21

Act. On May 3, 2023, the Utah Air Quality Board adopted R307-316, NOx Emission Controls for Natural
Gas-Fired Boilers Greater Than 5.0 MMBtu, as part of these efforts. Rule R307-316 reduces NOx
emissions from industrial, commercial, and institutional natural gas-fired boilers in Salt Lake, Weber,
Davis, Tooele, and Utah counties by requiring that any new boiler, or burner installed on a boiler, in these
areas be certified to emit no more than nine parts per million by volume (ppmv) of NOx while operating.
These rules do not require retrofits or replacements of any existing boilers and are only required for boilers
operating on pipeline quality natural gas, and thus do not apply to facilities which operate boilers using
plant gas such as refining operations.

As a result of feedback received from discussion by the Utah Air Quality Board during the final adoption
of R307-316, conversations with boiler manufacturers and distributors, as well as feedback from sources as
they work towards the initial implementation date, the Utah Division of Air Quality is proposing the
following minor amendments to R307-316:
1) Moving applicability language originally located in Section R307-316-4 to Section R307-316-2;
2) a carbon monoxide (CO) limit of 200 ppmv has been added;
3) a definition of “combustion analysis” was added; and
4) the definitions of “construction” and “modification” were modified.
These amendments are proposed in efforts to:
1) Clarify the applicability of the rule while making it easier to read;
2) provide additional mechanisms to verify compliance with the rule;
3) provide clarity for how compliance with the rule can be achieved; and
4) bring definitions in line with the intent of the rule while simultaneously making these definitions
more consistent with those found elsewhere in state and federal rules.
The division anticipates that a 30-day public comment period for the proposed amendments would run
from May 15, 2024, to June 14, 2024. This timeline would give stakeholders a total of 45 days from
proposal to close of the public comment period to review the proposed amendments and provide comment
to the division.
Recommendation: Staff recommends the Board approve amendments to R307-316, NOx Emission
Controls for Natural Gas-Fired Boilers Greater Than 5.0 MMBtu, for a 30-day public comment period.

“modification” and “construction” to clarify the intent of the rule, the applicability of the rule, and makes these definitions more
consistent with federal definitions, and 4) moves applicability language from Section R307-316-4 to the applicability Subsection
in Section R307-316-2 to provide additional clarity for when the rule is applicable.

R307-316-1. Purpose. 4
Rule R307-316 establishes maximum emission thresholds for the emissions of oxides of nitrogen 5
(NOx) and carbon monoxide (CO) for new or modified natural gas-fired boilers with a total rated heat 6
input greater than 5.0 million British Thermal Units per hour (MMBtu/hr). 7

R307-316-2. Applicability. 9
(1) Rule R307-316 applies to each boiler that[ begins construction or modification after the10
compliance date defined in Section R307-316-6 that]: 11
(a) is fueled exclusively by natural gas;12
(b) has a total rated heat input greater than 5.0 MMBtu/hr;13
(c) is an industrial boiler, institutional boiler, or commercial boiler;14
(d) is located in Salt Lake, Utah, Davis, Weber, or Tooele County; and15
(e) [is not a temporary boiler.]undergoes one of the following after the compliance date defined16
in Subsection R307-316-6(4): 17
(i) begins construction, or modification of a boiler;18
(ii) replaces a burner in a boiler having only a single burner; or19
(iii) replaces 50% or more of the burners in a multi-burner boiler.20
(2) [Exemptions to this rule include]Rule R307-316 do not apply to:21
(a) residential boilers as defined in this rule;22
(b) CO boilers as defined in this rule;23
(c) waste heat boilers as defined by this rule;[ and]24
(d) process heaters as defined by this rule[.]; and25
(e) temporary boilers as defined by this rule.26
(3) References to 40 CFR in Rule R307-316 shall mean the version of the Code of Federal27
Regulations that is effective as of the date referenced in Section R307-101-3. 28

R307-316-3. Definitions. 30
As used in this rule: 31
"Boiler" means an enclosed device using controlled flame combustion of natural gas, as defined 32
by this rule, in which water is heated to recover thermal energy in the form of steam or hot water. 33
Controlled flame combustion refers to a steady-state, or near steady-state, process wherein fuel or 34
oxidizer feed rates are controlled. 35
"Burner" means the functional component of a boiler that provides the heat input by combustion 36
of a fossil fuel with air or oxygen. Burners are available either as part of the boiler package from the 37
manufacturer, as stand-alone products for custom installations, or as replacement products. 38
"CO boiler" means a boiler that is fired with gaseous fuel with an integral waste heat recovery 39
system used to oxidize CO-rich waste gases generated by a Fluid Catalytic Cracking Unit. 40
“Combustion analysis” means an analysis performed on flue gases using a portable instrument 41
which measures a range of variables relevant to the byproducts of combustion including temperatures, 42
draft pressure, concentrations of oxygen, and concentrations of pollutants. 43
"Commercial boiler" means a boiler used in commercial establishments such as hotels, 44
restaurants, and laundries to provide electricity, steam, or hot water. 45
"Construction" means any physical change or change in method of operation including 46
fabrication, erection, installation, demolition, or modification of an emission unit [boiler which ]that 47
would result in a[n] potential increase in [actual NOx ]emissions. 48
"Industrial boiler" means a boiler used in manufacturing, processing, mining, and refining or any 49
other industry to provide steam, hot water, or electricity. 50
"Institutional boiler" means a boiler used in institutional establishments such as medical centers, 51
nursing homes, research centers, institutions of higher education, elementary and secondary schools, 52
libraries, religious establishments, and governmental buildings to provide electricity, steam, or hot water. 53

"Modification" means any planned change in a [boiler]source which results in a[n increase of 1
actual NOx] change in emissions. 2
"Natural gas" means: 3
(1) a mixture of gaseous hydrocarbons, with at least 80% methane by volume, and of pipeline4
quality, such as the gas sold or distributed by any utility company regulated by the Utah Division of 5
Public Utilities; 6
(2) Liquefied petroleum gas, as defined by the American Society for Testing and Materials in7
ASTM D1835, or propane, propane-derived synthetic natural gas, or mixtures thereof; or 8
(3) propane or propane-derived synthetic natural gas.9
"Process Heater" means an enclosed device using controlled flame, and the unit's primary purpose10
is to transfer heat indirectly to a process material such as liquid, gas, or solid, or to a heat transfer material 11
such as glycol or a mixture of glycol and water, for use in a process unit, instead of generating steam. 12
Process heaters are devices in which the combustion gases do not come into direct contact with process 13
materials. Process heaters include units that heat water and water mixtures for pool heating, sidewalk 14
heating, cooling tower water heating, power washing, or oil heating. 15
"Propane" means a colorless gas derived from petroleum and natural gas, with the molecular 16
structure C3H8. 17
"Residential boiler" means a boiler used to provide heat or hot water as part of a residential 18
combined heat and power system. This definition includes boilers located at an institutional facility such 19
as a university campus, military base, church grounds or commercial or industrial facility such as a farm 20
used primarily to provide heat or hot water for: 21
(1) a dwelling containing four or fewer families; or22
(2) a single unit residence dwelling that has since been converted or sub-divided into23
condominiums or apartments. 24
"Temporary boiler" means any gaseous or liquid fuel-fired steam generating unit that is designed 25
to, and is capable of, being carried or moved from one location to another by wheels, skids, carrying 26
handles, dollies, trailers, or platforms. A steam generating unit is not a temporary boiler if any one of the 27
following conditions exists: 28
(1) the equipment is attached to a foundation;29
(2) the steam generating unit or a replacement remains at a location for more than 18030
consecutive days. Any temporary boiler that replaces a temporary boiler at a location and performs the 31
same or similar function shall be included in calculating the consecutive time period; 32
(3) the equipment is located at a seasonal facility and operates during the full annual operating33
period of the seasonal facility, remains at the facility for at least two years, and operates at that facility for 34
at least three months each year; or 35
(4) the equipment is moved from one location to another in an attempt to circumvent the36
residence time requirements of this definition. 37
"Waste heat boiler" means a device that recovers normally unused energy such as hot exhaust gas 38
and converts it to usable heat. Waste heat boilers are also referred to as heat recovery steam generators. 39
Waste heat boilers are heat exchangers generating steam from incoming hot exhaust gas from an 40
industrial or power equipment such as thermal oxidizers, kilns, furnaces, combustion turbines, and 41
engines. Duct burners are sometimes used to increase the temperature of the incoming hot exhaust gas. 42
43
R307-316-4. Requirements. 44
(1) Except as provided in Subsection R307-316-4(3), an [person]owner or operator of a boiler45
subject to this rule shall[ that]: 46
[ (a) begins construction, or modification of a boiler;47
(b) replaces a burner in a boiler having only a single burner; or48
(c) replaces 50% or more of the burners in a multi-burner boiler for a boiler meeting the49
requirements of Section R307-316-2 shall install a burner that meets a NOx emission rate of nine parts per 50
million by volume (ppmv) or less at 3% volume stack gas oxygen on a dry basis.] 51
(a) install a burner that meets a NOx emission rate of nine parts per million by volume (ppmv) or52
less at 3% volume stack gas oxygen on a dry basis; and 53
(b) meet a CO emission rate of 200 ppmv or less at 3% volume stack gas oxygen on a dry basis.54

(2) An owner or operator of a boiler subject to Subsection R307-316-4(1) shall:1
(a) operate and maintain the boiler and boiler subsystems, including burners, according to the2
manufacturer's instructions; 3
(b) determine continued compliance based on Section R307-315-6; and4
(c) ensure that manufacturer's operational specifications, records, and testing of any control5
system shall use the applicable EPA Reference Methods of 40 CFR Part 60, the most recent EPA test 6
methods, or EPA-approved state methods, to determine the efficiency of the control device; and 7
(d) meet the applicable recordkeeping requirements for any control device.8
(3) Any person may apply to the director for approval of an alternate method of control. The9
application shall include a demonstration that the proposed alternate produces an equal air quality benefit 10
as required by Subsection R307-316-4(1)(c) or that meets Best Available Control Technology thresholds. 11

R307-316-5. Recordkeeping. 13
(1) The owner or operator of any boiler subject to [Rule]Section R307-316-4 shall:14
(a) retain documentation of the unit's emission rate specifications;15
(b) retain a copy of the manufacturer's recommendations for proper operation and maintenance16
of units covered by Rule R307-316; 17
(c)maintain records showing proper operation and maintenance of units covered by Rule R307-18
316 following manufacturer's recommendations; and 19
(d) retain a record of approval of any alternative method of control as outlined in Subsection20
R307-316-4(3). 21
(2) Operation and maintenance records shall be retained for five years and shall be made22
available to the director upon request. 23

R307-316-6. Compliance Determination and Schedule. 25
(1) Compliance with the NOx emission requirement listed in Subsection R307-316-4(1)(c) shall26
be determined according to the following procedures: 27
(a) U.S.EPA Reference Method 7E, Determination of Nitrogen Oxides Emissions from28
Stationary Sources; 29
(b) a continuous in-stack nitrogen oxide monitor or equivalent verification system in compliance30
with 40 CFR Part 60 Appendix B Specification 2; 31
(c) other EPA-approved testing methods acceptable to the director; or32
(d) combustion analysis as part of a regular maintenance schedule.33
(2) Compliance Determination shall be conducted according to the following frequency:34
(a) once every three years for units with a rated heat input capacity greater than or equal to 1035
MMBtu/hr, except for boilers subject to Subsection R307-316-6(1)(b); and 36
(b) once every five years for units with a rated heat input capacity less than 10 MMBtu/hr down37
to and including 5 MMBtu/hr. 38
(3) Provided an emissions test is conducted within the same calendar year as the test required in39
Subsection R307-316-6(2), an owner or operator may use the following emissions tests to comply with 40
Subsection R307-316-6(2): 41
(a) periodic monitoring or testing of a unit as required in a Title V permit; or42
(b) relative accuracy testing for continuous emissions monitoring verification pursuant to 4043
CFR Part 60 Appendix B Specification 2. 44
(4) The compliance schedule for this rule shall begin on May 1, 2024.45
