Subpart AAAA Applicability – CDS A; MACT (Part 63), Nonattainment or Maintenance Area,

The Division of Air Quality (DAQ) has determined that an error exists in Approval Order (AO)
DAQE-AN101290026-22, dated August 12, 2022. The AO has 40 CFR 63 Subpart AAAA – National
Emissions Standards for Hazardous Air Pollutants: Municipal Solid Waste Landfills as an applicable
federal standard. At the time of the issuance of AO DAQE-AN101290026-22, the Wasatch Integrated
Waste Management District – Davis Landfill was and is not subject to MACT Subpart AAAA.

Therefore, the DAQ will remove the applicability of MACT Subpart AAAA when a new AO is issued.
