That Approval Order (AO) is for updates to a previous AO (DAQE-101230053-22) which authorized the construction and operation of various equipment changes at the facility. Following issuance of this most recent AO, construction has not yet begun on three pieces of equipment, namely: II.A.107 – Tank 90, II.A.108 – Tank 92, and II.A.151 – Tank 170. The requirements found at R307-401-18, Eighteen Month Review, establish a review requirement for Approval Orders (AOs). This requirement applies to all AOs we issue. On January 31, 2014, the EPA issued a guidance memorandum which outlines “...what constitutes adequate justification for an extension of the 18-month timeframe for commencing construction...” UDAQ has reviewed this guidance memorandum and developed a guidance document dated March 25, 2014, that identifies the criteria the UDAQ Director will use in a review of requests for extension of the 18-months to commence construction requirement. In your request of November 21, you provided details of the ongoing engineering and evaluation process. Such factors are the precise justification discussed in the guidance memorandum and are therefore acceptable to UDAQ. By no later than May 15, 2025, HF Sinclair Woods Cross Refining LLC shall notify the Director of the status of construction, installation, modification, relocation or establishment of the equipment listed in section II.A of the AO. 3. This initial permit extension is not subject to public notice or comment, nor is any additional review or permit analyses required, per the EPA and DAQ guidance identified above. Any additional extension requests beyond the initial 18-month period shall be reviewed on a case-by-case basis at the time of the request. At that time public notification and comment shall be required, along with the associated re-analysis and update of PSD requirements or re-submittal of an application as may be required. The charge for the review done in making this change is a flat fee plus a filing fee as authorized by the Utah Legislature. You will receive an invoice for these charges shortly.
