HomeMy WebLinkAboutDSHW-2024-006119E&P Proposed Draft Rules Brian Speer, Solid Waste Program Manager The Division of Waste Management and Radiation Control will regulate the disposal of solid and hazardous wastes generated from the exploration, development, or production of crude oil and gases, including drilling fluids, muds and other liquid wastes. Introduction. Permiing Proposed modifications to the Solid Waste Permiing and Management Rules have been drafted for the regulatory shift of Exploration & Production Waste (E&P) from the Division of Oil, Gas and Mining to the Division of Waste Management and Radiation Control. Regulatory Changes Landfarms Disposal Evaporation Ponds R315-321 for Class VII Landfills R315-322 for Class VII Solid Waste Surface Impoundments (Evaporation Ponds) Closure of all or part of the existing footprint prior to transition date. DOGM Permit Closure DWMRC Permit Closure Closure of all or part of the existing footprint under Post Closure Permit. DWMRC Solid Waste Permit Permit all or part of a facility to comply with standards under new rules. Landfarm and Evaporation Pond Options. Corrective Action Standards ●Meet background or risk-based concen- tration levels Landfill Closure ●Soil Cap ●Vegetation ●Monitoring and repair of erosion DWMRC Closure Requirements Facility Status Existing Facility A facility that had a DOGM or DWMRC permit on [Date] New A facility that did not have a DOGM or DWMRC permit on [Date] Laterally Expanding An expansion of a facility outside of the approved boundary in its DOGM or DWMRC permit. Draft Rule Highlights Location Standards Plan of Operation Recordkeeping Reporting and Fees Design Standards Operation Standards Design Standards Run-On / Run-O Control Groundwater Monitoring Liners Tank Secondary Containment ●Required for landfills accepting VSQG waste ●Existing surface impoundments must maintain existing groundwater monitoring and may not be in assessment or corrective action to accept VSQG waste ●Required for new or laterally expanding surface impoundments ●When location standards are met, no liner required for landfills ●Surface impoundments must have either a liner that meets R315-303-3(3) and groundwater monitoring wells, or a dual lined system with leak detection Permiing and Financial Assurance Applications due no later than December 1, 2024. Temporary Permits Application deadlines estab- lished in temporary permit. Permit Applications Funding must meet financial assurance estimates before a full permit is issued.
