This letter is notification that Big West Oil, LLC (BWO) is filling Tank 31. BWO has determined that Tank 3l will
be subject to 40 CFR 60 Subpart Kc if the proposed rule is codified in its current form. As such, BWO is submitting
the notification in accordance with the proposed rule and Utah R307-327-5(5). Upon startup, Tank 3l will comply
with the requirements from 40 CFR 60 Subpart Kc, but BWO may perform another applicability assessment if the
codified rule differs from the proposed rule. The tank's initial fill date depends upon the construction completion
and is currently planned for May 1"1,2024.
