RE:Class 2 Modification Approval – Additional Container Pumping Station and Storage Capacity in E-4 DecantUTD981552177
Dear Mr. Simmons:
On May 30, 2023, Clean Harbors Aragonite (Aragonite) submitted a Class 2 permit modification request seeking approval to construct and operate an additional container pumping station
and add the ability to store containers in the E-4 decant area.
As part of the Class 2 modification process, a 60-day public comment period and an informational public meeting were held. No public comments were received.
Following review of the request, the Division of Waste Management and Radiation Control issued an approval to construct the additional container pumping station on August 31, 2023.
On April 3, 2024, Aragonite submitted a construction certification indicating the additional container pumping station had been constructed andwas ready for use. Division staff inspected
the newly constructed container pumping station on April 8, 2024, and determined that construction of the feed piping had not yet been completed. On April 11, 2024, Aragonite submitted
an amendment to the construction certification indicating that the unfinished elements of the feed piping had been completed, and also indicated that the E-4 decant storage areafloor
had been painted to delineate the container storage locations outlined on permit drawing D-800-M-402. Photos were also included with the amended construction certification to confirm
these most recent changes.
During review of the construction certification for the additional container pumping station, an issue was noted with drawing D-800-M-402 and the new storage capacity listed on the drawing
capacity table versus that shown for building E-4. The discrepancy was resolved when Aragonite submitted a corrected drawing.
Based upon our review of the latest construction certification information and the on-site inspection, the Class 2 modification is approved as enclosed.
Aragonite should update its copy of the permit by making the following changes:
Replace Module 3 – Storage and Treatment in Containers with the enclosed copy.
Replace Attachment 3 – Inspections with the enclosed copy.
Replace Attachment 7 – Closure Plan with the enclosed copy.
Replace Attachment 7, Appendix 1 – Closure Cost Estimate with the enclosed copy which consists of two separate files that combine to form the Appendix.
Replace Attachment 8 –Waste Storage, Processing, and Tracking with the enclosed copy.
Replace Attachment 10 – Design Drawings with the enclosed copy.
Replace Attachment 12 – WFCO Systems Testing Procedure with the enclosed copy.
Replace Attachment 13 – Instrument Calibration with the enclosed copy.
Replace Attachment 14 – Fume Management with the enclosed copy.

Also enclosed is an updated copy of theList of Permit Revisions.
As part of this approved permit modification, the container storage capacity at the facility has been increased. Accordingly, the closure cost estimate, as indicated in Attachment 7,
Appendix 1, has increased to a current value of $20,228,969.
Effective with this approval to begin using the additional container pumping station and additional container storage in building E-4, a 60-day window begins during which Aragonite must
update the facility financial assurance mechanism (closure insurance) to address the increase in the estimated closure cost estimate associated the increased storage capacity and provide
evidence of this update to the Division with an updated Certificate of Insurance for Closure or Post-Closure Care.
