Dear Mr. Williams:
The Utah Underground Storage Tank Act (Act) regulates Underground Storage Tanks
(USTs) and imposes certain obligations on the owner or operator of a facility having USTs. The
Act specifically requires the owner or operator of a facility with USTs, to meet the following
requirements:
Obtain and maintain a Certificate of Compliance
Maintain Financial Assurance meeting the federal requirements
Maintain release detection on the tank and piping
Maintain corrosion protection
Maintain spill and overfill protection
Pay annual fee(s) and Petroleum Storage Tank (PST) Fund Assessments as
required
Perform any corrective action as required
Properly perrnanently close any UST not meeting these requirements
At the request of the Executive Secretary (UST), the Division of Environmental Response
and Remediation (DERR) performed a compliance review for the facility owned or operated by
R. Williams/Trustee. This facility is located at 560 North Washington Boulevard, Ogden, Utah.
The designated Facility Identification Number is 1200551. This facility contains two UST(s).

The compliance review indicates you have not satisfied the requirements. To achieve
compliance, you must do all of the following:
Submit and obtain approval of a Closure PIan for proper permanent closure of the
USTs found in non-compliance since December 22, 1998, and perform the closure
as approved within 30 days.
Submit a Closure Notice within 60 days of the proper permanent closure,
documenting the proper permanent closure of the USTs found in non-compliance
since December 22, 1998.
Pay past due fiscal years 1998 through 2005 UST Registration Fees in the amount
of $4,548.00, plus accruing interest.
Perform any corrective action required (cleaning up any contamination found upon
removal of the UST systems).
The Act gives the Executive Secretary (UST) of the Utah Solid and Hazardous Waste
Control Board (Board) the power to enforce rules made by the Board by issuing Notices of
Agency Action or Orders. The Act, Utah Code Ann., Sections 19-6-407 and 19-6-408, also gives
the Executive Secretary (UST) the power to assess a civil penalty of $ I,000.00 UST fails to
register the tank, assess $ I,000.00 for failure to pay fees within 60 days of due date, and assess
interest on the unpaid balance. Other violations of the Act may result in civil penalties of up to
$10,000.00 per day.
This letter will advise you that your failure to comply with the requirements of the statutes
and rules by June 31.2005. may result in the issuance of a Notice of Agency Action or Order and
the assessment of a civil penalty.

RIiCOMMENDATION
Deem fee and fund amounts un-collectible in accordance with Executive Secretary policy
described below, because fee and fund amounts were incurred before current owner
obtained ownership, tanks were not operated after current owner obtained the tanks, and
the current owner closed the tanks within a reasonable period of time after acquiring them,
or becoming aware of their existence.
Waive penalty for non-payment of registration fees because no fuel has been dispensed
from the tank on or after July I , 1991.
(X). Waive fund fees, interest and penalties.
LEGAL A RITY
l. under the policy adopted by the Executive Secretary on June 7, 1994:
a.The Executive Secretary will not issue a Certificate of Compliance unless
all past-due PST and registration f'ees, interest and penalties, are brought
current, regardless of whether there has been a change in ownership.
The Executive Secretary may decline to exercise his discretion to actively
pursue collection of past-due PST and registration fees, penalties and
interest, if the current owner (who has never operated the tanks) closes the
tanks within a reasonable time period.
2. Under the 1994 amendments to the Underground Storage Tank Act
a.The Executive Secretary may waive any penalty (not registration fees and
interest) assessed under l9-6-408(-5d) Utah Code (registrarion fee) if no fuel
has been dispensed from the tank on or after July l, 1991.
The Executive Secretary may waive all or part of the fees (by implication
this includes penalties and interest) required for a petroleum storage tank,
underUtah Code' 19-6-4ll(10) if no fuel has been dispensed from the tank
on or after July l, 1991.

The attached list contains all facilities that still have prior year PST Fund fee assessments. These
flccs were assessed during the FYl99l - 1997 timeframe when the PST Fund was mandatory and
the fee was assessed on all tanks regardless if they were participating in the fund or even if they
were not being used. These fees have been on the books for years but we no longer assess the
PST fee for these past years on newly found non-notifiers and do not include the unpaid PST fund
amounts when issuing orders (based on attorney's instruction). Typically when we get to the stage
of sending an order, we send through a fee waiver memo for the specific facility and request to
waive the PST amount that is owing. This memo is an effort to resolve all of the remaining
facilities with one memo and remove the uncollectible PST fund fees from or Accounts
Receivable report.

The Utah Underground Storage Tank (UST) Act provides that the Executive Secretary (UST) may
invoke fines if it is determined that a facility is not in substantial compliance with all state and federal
UST statutes, rules and regulations.
At the request of the Executive Secretary (UST), the Division of Environmental Response and
Remediation (DERR) performed a compliance review for the underground storage tanks at the above
facility. The compliance review, performed on29lIQY2000_, indicates you have not satisfied the
requirements of the Act and are out of compliance. To achieve compliance you must do the following:

Division of Environmental Response and Remediation (DERR) records show you have one or more underground storage tanks
(USTs) which are not in compliance. These tanks are located at RAY'S TRANSMISSION, 560 N WASHINGTON BLVD,
OGDEN, facility ID+f 1200551.
Under Federal regulations issued in 1988, UST owners and operators have until December 22, 1998 to upgrade, replace, or
permanently close USTs which do not meet the requirements for protection against spills, overfills, and corrosion. Owners and
operators also must meet financial responsibility requirements, to show they are able to pay the costs of cleanups of releases from
regulated USTs. In addition, the Utah UST Act requires that all owners and operators of regulated petroleum USTs qualify for
and maintain a Certificate of Compliance. The tanks listed below are not currently covered by a Certificate of Compliance, and
you have not adequately demonstrated that you meet the financial responsibility requirements. The USTs also have not yet met
the upgrade requirements, as shown below:

imposes certain obligations on the owner or operator of a facility having USTs. The Act specifically requires
the owner or operator of a facility, with uSTs, to meet the following requirements:
Register the USTs
Pay an annual registration fee
Pay an annual Petroleum Storage Tank (PST) Fund fee
Meet specific technical and performance standards
Meet certain financial responsibility requirements
Maintain adequate tank records
Participate in the PST Fund
Precision test the tank and lines as a requirement to participate in the pST Fund
The Division of Environmental Response and Remediation (DERR) records indicate you own or
operate two (2) USTs located at Ray's Transmission, 560 North Washington Blvd., Ogden, Utah.
Information provided to the DERR indicates your facility is not in compliance with the
following requirements:
1. The DERR has not received any documentation to establish that these USTs have been properly
closed.
2. The DERR has not received payment for registration fees and interest now past due, for the fiscal
years 1989-1998.
3. The DERR has not received payment for PST Fund fees, late penalties and interest, now past due for
the fiscal years 1991-1998.

In order to achieve compliance you must do the following:
1. Submit an updated notification form.
2.Subrnit a properly completed subsequent closure notice and other documentation to establish
the USTs have been properly closed.
Submit payment for registration fees and interest, now past due, for the fiscal year(s) 1989-
1998, in the amount of $2,749.02.
Submit payment for PST Fund fees, late penalties and interest, not past due, for the fiscal
years(s) 1991-1998, in the amount of $4,491.36.
Submit an approvable closure plan, obtain approval, perform the closure as approved within
60 days, and submit a properly completed subsequent closure notice and other documentation
within 90 days of closure to establish the USTs have been properly closed.
The Act gives the Executive Secretary (UST) of the Utah Solid and Hazardous Waste Control Board
(Board) the power to enforce rules made by the Board by issuing Notices of Agency Action or Orders. The
Act, Utah Code Ann., Sections 19-6-407 and l9-6-408, also gives the Executive Secretary OST) the power
to assess a civil penalty of $ 1 ,000 if an owner or operator of an UST fails to register the tank, $ 1 ,000 for failure
to pay fees within 60 days of due date, and assess interest on the unpaid balance. Other violations of the Act
may result in civil penalties of up to $10,000 per day.
This letter will advise you that your failure to comply with the requirements of the statutes and rules
may result in the issuance of a Notice of Agency Action or Order and the assessment of a civil penalty.
Once the USTs have been properly closed and registration fees have been paid, the PST Fund fees,

The Utah Underground Storage Tank (UST) Act provides that the Executive Secretary (UST) may
invoke fines if it is determined that a facility is not in substantial compliance with all state and federal
UST statutes, rules and regulations.
At the request of the Executive Secretary (UST), the Division of Environmental Response and
Remediation (DERR) performed a compliance review for the underground storage tanks at the above
facility. The compliance review, performed on 21 Julv 1997 , indicates you have not satisfied the
requirements of the Act and are out of compliance. To achieve compliance you must do the following:
1. Pay all back Registration Fees and Petroleum Storage Tank Fund Fees.
2. Submit a completed Notification Form (enclosed)
3. Bring the tank(s) into compliance and on the PST Fund OR properly close the tank(s)
