Lake regarding the amendment to the White Mesa Mill license. To ensure DRC is able to fully address my

QUESTIONS FOR OCTOBER 9,2013, HEARING

The following questions are submitted by Anne Mariah Tapp on behalf of the Grand
Canyon Trust in anticipation of a hearing before a Presiding Officer in Salt Lake City, Utah, on
October 9,2013. The hearing relates to Energy Fuels Resources Inc. (EFRI) request for an
amendment to the White Mesa Uranium Mill Radioactive Materials License UT1900479. EFRI
has requested authorization to process waste from another mineral processing operation. The
waste is from the Dawn Mining Company's (DMC) Midnite Mine, Wellpinit, Washington. The
application submitted to the Utah Division of Radiation Control was dated April 27,2011, and
supplemented by documents dated December 5,2012, June 14 and August 7,2013. These
questions are timely submitted ten days before the hearing, on September 30,2013.
Questions
1. What testing did the Utah Division of Radiation Control (DRC) perform evaluate the
compatibility of the liners of cells 4A and 4B with the alternate feed material proposed to be
accepted from the Midnite Mine site? What were the results of that testing?
2. What testing will be undertaken to determine whether the groundwater protection standards
for barium contained in 10 CR Part 40, Appendix A, Criterion 5C are being met at the Mill?
3. How can Utah implement a program at least as stringent as the Nuclear Regulatory
Commission's (NRC) where NRC prepared a National Environmental Policy Act (NEPA)
analyses for each of the pre-Agreement State alternate feed proposals but DRC has not prepared
an environmental analysis for the receipt and processing of alternate feed from the Midnite Mine
site?
4. What regulatory action has been taken to address and eliminate the off-site deposition
identified in the United States Geologic Survey report dated Feb. 8, 2012 (Attached as Exhibit
A)? Practical steps by Denison, Energy Fuels?
5. How would the talc-like composition of the Midnite Mine alternate feed materials
exacerbate off-site deposition problems identified in USGS report?
6. What periods of time can these tailings be exposed without a water cover? Will a 1 meter
water cover be required at all times for these tails? Please describe dusting and radon emission
impacts that can occur when the waste from processing these wastes are not covered?
