Dear Mr. Frydenlund:
On December 15, 2011 DUSA submitted a request for an amendment to its Radioactive Materials

resulting tailings in the Mill's tailings impoundments as 1 le.(2) material.
Review of the request will be conducted by the Utah Division of Radiation Control (DRC) after
the Memorandum of Agreement (MOA) is signed by both parties initiating the review of
Reclamation Plan 5.0 and the Infiltration Contaminate Transport Model, and the DUSA License
Renewal process is completed and the Revised License is signed by the Executive Secretary.
