Dear IVIr. Lundberg:
This letter responds to the Utah Department of Environmental Quality's ("DEQ's") above-named Notice of
Enforcement Discretion regarding the Annual Surety Update for Denison Mines (USA) Corp.'s ("Denison's)
White Mesa Mill. The letter states that: "As of the date of this letter, we are unaware of any surety submittal
made by DUSA to comply with the requirements of reference a. above." Reference a, specifically cites the
Radioactive Materials License Condition 9.6 which requires annual updates to the surety amount to be
submitted by March 4 of each year.
Denison submitted the required updated surety estimate, entitled "Attachment C White Mesa Mill Reclamation
Plan revision 4.5, Revised Costs Estimates for reclamation of the White Mesa Mill and Tailings Management
System" by Federal Express on Friday, March 4, 2011. Attachment 1 to this letter contains the Federal
Express shipment tracking records demonstrating that the document was shipped on Friday May 4, 2011,
delivered to DEQ on Monday, March 7, and signed for by one J. Olsen of DEQ at the time of delivery.
If DEQ is unable to locate the document delivered in March, Denison would be pleased to send a
replacement copy. We would appreciate if you would respond at your soonest possible convenience to
confirm that the updated surety estimate was submitted as required in compliance with License Condition 9.6,
and that the Notice of Enforcement Discretion was sent in error and will be retracted.
