Surety Update Amount was not formally Approved in 2010
References:
a. The subject radioactive materials license condition 27 requires, "Annual updates to the
surety amount, required by UAC R313-24 (10 CFR 40, Appendix A, Criteria 9 and 10, as
incorporated by reference), shall be submitted to the Executive Secretary by June 30 of
each year."
b. Earlier, the June 17, 2010 Rio Algom Mining Letter, "requests that the surety of
$2,214,366 remain unchanged.
c. September 24, 2009 DRC Letter stating that, "Pending RAM's submittal of this [certain
listed items, including a closure report] information and DRC's review and approval
thereof, the existing surety amount must remain constant at $2,214,366.
As mentioned in the subject block, the 2010 surety amount proposed in reference b above was not
formally approved via letter by Utah DRC in 2010.
However, in reference c above, DRC requested that the surety amount shown remain constant,
until the listed conditions in reference c above are satisfied. The listed items have not been
submitted to date. Therefore the approved surety amount currently remains unchanged at
$2,214,366.
