SUBJECT: Close-out of Freeboard Exceedance Issues for Cell 3
White Mesa Uranium Mill, Blanding, Utah
References:
1. DRC letter dated November 20, 2008 granted interim variance freeboard elevation requirements
for the subject tailings Cell 3.
2. DUSA email notices and letters, individually dated October 9 and December 15, 2008, May 26,
October 20, and November 23, 2009, March 3, June 21, August 4, and September 15, 2010, regard
freeboard issues at tailings Cell 3.
3. DRC letters dated January 20, 26, 26, and 27, 2011 respectively, which contingently approved the
new DMT Plan to eliminate the freeboard requirement for Cell 3 upon authorization for use of Cell
4B, approved the as-built report for Cell 4BT approved the operational and maintenance procedures
for new Cell 4B (the O&M Plan), and authorized Cell 4B to operate. These items were referred to
in reference 1 above.
4. DUSA Radioactive Materials License Condition 10.3.B and 10.3.C.
Upon authorization of the use of tailings Cell 4B and approval of the DMT and Cell 4A O&M Plans per
referenced above, the License Conditions of reference 4 effectively eliminated the former freeboard
elevation requirements for tailings Cell 3. These approvals also resolve previous freeboard exceedance
issue problems as discussed in reference 1 and 2 above. Therefore, former issues regarding the subject
freeboard exceedances for tailings Cell 3 are hereby closed-out.
