COX Lieutenant Governor DRC-2014-003901 June 12,2014 David Frydenlund Vice President Regulatory Affairs and Counsel Energy Fuels Resources (USA) Inc. 225 Union Boulevard, Suite 600 Lakewood, Colorado 80228 RE: Additional Air Monitoring Locations, Revised Environmental Monitoring Manual, Dawn Mining License Amendment - Public Participation Summary: Radioactive Material License Number UT 1900479 Dear Mr. Frydenlund: Due to comments received from the public regarding the Dawn Mining Alternate Feed Amendment Request, the Division of Radiation Control (DRC) has inserted a new license condition, Condition 11.9, into Energy Fuels Radioactive Material License. This condition requires the licensee to submit a revised Environmental Monitoring Manual within sixty days after approval of the Dawn Mining Alternate Feed Amendment including two additional air monitoring stations. In recent discussions with the licensee regarding the placement of the two additional air monitoring stations, the licensee has requested the DRC provide a determination regarding the most appropriate locations for the new air stations. As part of that request, the DRC has reviewed the following: 1) the site wind rose data from 2004 through 2013; 2) the U.S. Geological Survey (USGS) Scientific Investigations Report 2011-5231 (Report); and 3) closest proximity ofthe nearest resident and potential nearest resident. Based on this review, the DRC concurs with the licensee's proposed locations for the two new air stations as follows: One station 0.59 miles west of BHV-1 along the North property line (Lat: 37°33'6.69"N, Long: 109°30'5.29"W); and a second station located 0.82 miles south of BHV-1 along the east side property line (Lat: 37°32'35.36"N, Long: 109°29'35.02"W).
