On December 2, 2011 DUSA provided (by e-mail) a redline/strikeout version and a clean
blackline copy of the DUSA Contingency Plan. These changes to the DUSA Contingency Plan
are a result of a November 22, 2011 conference call w^here DRC review^ comments and DUS A
concerns, were discussed.
Examples of the most significant changes to the DUSA Contigency Plan Rev. 4 included:
• A requirement for prior Executive Secretary approval for disposal of unauthorized
materials in the tailings cells, w^as added to Section 4.2.d:
• A requirement for Executive Secretary approval of a schedule goveming activities
associated with permanent disposal of unauthorized materials discovered during placement
in the tailings cells, was added to the general requirements of Section 4.3.
• A new Section 5.4 was added regarding the Cell 4B leak detection system.
After review of this document, this letter serves as the Executive Secretary approval of the DUSA
Contingency Plan, which is now in effect.
