Consent Decree Written Notice
Dear Mr. Lundberg and Ms. Hale
Dawn Mining Company, LLC/Newmont USA, Limited (Dawn/Newmont) provides this
written notice in accordance with the United States v. Dawn and Newmont Consent
Decree. Dawn and Newmont will ship Midnite Mine residual solids to the Energy Fuels
Resources (USA) Inc., White Mesa Uranium milling facility, 6425 Highway 191,
Blanding, Utah as alternative uranium feed stock in accordance with the State of Utah,
Division of Radiation Control, Radiation Materials License (RML) UT 1900479,
Amendment 7.
The alternative uranium feed stock material will be identified as "UN 2910, radioactive
material, excepted package-limited quantity of material, 7 filter cake" on shipment
manifests and shipments are expected 2 to 3 times per week during the Midnite Mine
active water treatment period of April through October. Shipment quantities are
expected to average approximately 900 cubic feet or 45,000 pounds per shipment and
scheduled to using an over-the-highway commercial transporter. The material will be
contained with tripe lined super sacks which will be loaded approximately 7 super sacks
per 53 foot flatbed trailer. The super sacks will be strapped into place on the trailer deck
with each of the sacks containing a tarp cover.
