In response to the items in your e mail, here are the DRC conclusions
Item 1 If the container is from a new source that is from a new Licensed ISL Facility then disposal of the
container is appropriate If a facility has two separate licenses and this container is shipped under a separate
license that DUSA has received material and is under the 5 000 CY limit disposal of the container is also
appropriate
Example scenario where disposal of the container would not be appropriate The White Mesa Mill has
received 4,999 CY from a licensed facility that came from Area 1 at the facility, the Licensed Facility would also
like to ship ISL material from Area 2 to the White Mesa Mill under the same License Even though this is from a
different area (Area 2) at the facility, it would not be appropriate to dispose of this container under the same
license, because the disposal volume for the licensed facility would be greater than the 5,000 CY limit
Item 2 DUSA has received 4,990 CY of ISL material from UEC Hobson The DRC will not grant a variance to
allow DUSA to accept ISL from one source greater than 5 000 CY In order for DUSA to be allowed to dispose
of the 50 remaining drums the 5 000 CY limit would have to be increased in the License
Item 3 DUSA is welcome to submit a request for a License Amendment to change the ISL disposal limit
However, the DRC will not consider the request until after May 8, 2012 due to some recent legislative appeal
process changes The DRC will also not approve the Amendment until the License Renewal Process is complete
and the ICTM and Reclamation Plan 5 0 have been approved

To clarify our phone call from last week and this morning we have asked three questions
1 Last week we asked regarding a verbal variance for a container we thought was from the same source as
other UEC lle,(2) The single container that we discussed last week is from a new source we do not need a
verbal or other variance Our RSO is assigning a new designated disposal area for material from that source
2 We expect 50 or more containers from the UEC Hobson source from which we have previously received close
to 4990 CY I asked you about Denison writing a request for a variance for more yards above (5,000 CY) for
materal from that source
3 I asked about the possibility of a future license revision that would get away from limiting lie (2) from every
source to 5 000 CY As our material receipts data shows, 5,000 CY is a reasonable volume estimate for some
sources, but is low for others
