Roberts Vice President, US Operations Denison Mines (USA) Corp (DUSA) 1050 17*^ Street, Suite 950 Denver, CO 80265 Dear Mr. Roberts: SUBJECT: January 21, 2011 Geosyntec Consultants Letter, DUSA Cell 4B Construction Quality Assurance [CQA] Report Addendum; January 20, 2011 DRC Letter, Review of Cell 4B Construction and Request for Information; Request for Information We received the subject January 21, 2011 DUSA Cell 4B Construction Quality Assurance [CQA] Report Addendum, furnished by Geosyntec Consultants. We have reviewed the subject addendum, and have the following comments and requests, which generally use the same corresponding comment number as in our subject letter of January 20, 2011: 3.b. Regarding Strip Drains, the Method to Change the Direction. Geosyntec provided catalog copies, and a single photo showing a linear connecting fitting, fitting location unknown. (1) . We stated that, "There are several locations shown on the original plans requiring the direction of the strip-drains to change. Please demonstrate the method used with example photographs* of such use [in-place]." Although perhaps misunderstood, our intent was to request photos* taken from on site, of such use. Please complete this request. (2) . We also stated that, "Numerous photographs of the strip-drain lines in Appendix M of the CQA Report as well as some surveyed strip-drain lines in Appendix K demonstrate strip-drain lines locations where the strip slimes drains have been turned from their original course to "short-cut intersect" the slimes drain header perpendicularly. Please demonstrate the method used at these locations with example photographs* of such use as well." Geosyntec responded that, ".. .the strip composite was simply bent to form a curve." For this item no photos were provided. Specific Strip Drains Nos. 31 and 51. We requested the following: (1). "Photographs' of reworked strip-drains 31 and 51, demonstrating no "piggy- backing" or "fallen dominoes" type stacking of those bags." The subject GeoSyntec response proposed photos no. 30 and 31 fulfill this requirement. However, these photos* are not definitive as the others supplied for strip drain documentation, due to the distant proximity of the photographs. Please complete this request. 5. New Item. Construction Drawing Sheet 7, Section E-4,7. The non-woven cushion geotextile covering the slimes drain header is not shown in the section drawing. Please revise this section to show the extent and termination of the non-woven cushion geotextile above the slimes drain header, above the slimes drain sump piping and up the embankment above the slimes drain sump access pipe. Please review the above comments, and respond in writing, supplying the requested documentation, including photographs, and needed adjustments, as Addendum No. 2 to the CQA Report. The addendum must be certified by a Utah-licensed Professional Engineer. Please include an electronic copy of the requested information. DUSA's response time on this letter is left to DUSA's discretion, in as much as the approval of Cell 4B CQA Report (As-Built Report) is a requirement of the Ground Water Discharge Permit, Part 1.H.9, for DRC authorization for use of Cell 4B.
