Dear Mr. Lundberg:
We are responding to the September 23, 2010 Request for Information from Dave Rupp asking for additional
clarification on the August 2010 update. Revision 4.2, of the White Mesa Mill reclamation cost estimates. Mr.
Rupp's comments are restated below, in italics, followed by our response. Where necessary, replacement
pages are provided for inclusion in the March and August 2010 estimates. These revisions are labeled
Revision 4.3, and also include the estimated cost for reclamation of tailings Cell 4B, that was submitted as
Revision 3.2 in June 2010.
1. Equipment Maintenance Hourly Rate. The fixed monthly equipment maintenance cost of 565,430
provided by North Central Rental and Leasing (NCRL) is exclusively for the machinery rented from
NCRL. Other equipment sources, such as Honnen Equipment or WWR Rental are not covered by
this monthly fixed cost. This was confirmed in a telephone conversation between Messrs. Oscar
Swenson of NCRL and David Rupp of DRC on September 14, 2010.
Therefore, it is appropriate to divide the NCRL monthly fee only by the total hours of NCRL monthly
equipment operation to derive an hourly maintenance rate for the NCRL equipment. For the
maintenance costs from the other equipment sources, we would be willing to accept the foregoing
derived rate for NCRL maintenance extended to that equipment DUSA may also propose other
additional documented equipment maintenance rates for the other equipment sources. Please
adjust the estimate to include this change in costs for equipment maintenance.
The calculated Hourly Equipment Maintenance Rate of $20.53 did in fact exclude the hours for the equipment
sourced from other vendors, but did include the outside equipment hours for the calculation of the allocation of
the monthly fuel cost for the maintenance equipment. Revising the fuel cost allocation changes the Hourly

Equipment Maintenance Rate to $20.57 per operating hour for the Butler equipment.This same rate has been
used for equipment sourced from other vendors as you suggested.Copies of the estimate summaries affected
by this change have been attached to this letter as revision 4.3.

3.Automobile and General Liability Insurance.The DUSA response generally satisfies our comment.
Additionally,we request that on the cost summary sheet the related line item be shown as "Motor
Vehicles and General Liability Insurance"or similar wording.
The summary sheet description has been changed to "Automobile and General Liability Insurance".
4.Reclamation Costs for the New Reagent Storage Building (NRSB).The DUSA response indicates
the NRSB has been added to the table for Alternate Feed Circuit Costs.This table has been
provided,but there are some inconsistencies needing correction:
a.The Haul Truck hours remained the same,but it appears they should be increased,as the
loader and truck driver hours,as well as the area ofconcrete to be removed were increased.
The haul truck hours have been changed to match the increase in the loader and truck driver hours.
b.The increased hours for loader and truck driver were only for 2-hours each.Please correct or
justify this as appropriate for the complete NRSB inventory,structure and concrete removal
work.
The Reagent Storage Building is a relatively small,wood frame structure,with metal siding and no insulation,
that can be easily demolished with the time and equipment specified.In order to add some conservatism to the
estimate,2 additional hours of the Cat 365 excavator were added to the estimate.
c.The Equipment Maintenance unit cost perhour in the costs in the table provided appears
erroneous,and needs to be corrected along with the above items.
The equipment maintenance unit cost has been corrected.

7.This is a new item.Updated surety estimates were submitted by DUSA letters dated June 29,2010
and August 19,2010.We have a question on the Cell 4A full surface area used in the fill
calculations presented by these submittals.In the July 2009 and March 3,2010 DUSA surety
estimates,the full surface area for Cell 4A has been presented as 1,829,520 square feet.In the
latest estimates mentioned above,that area is presented as 1,785,960 square feet.Please justify
the lower figure or provide corresponding corrections to the estimate.
The Cell 4A surface area of 1,829,520 ft'is 42.0 acres,which was originally calculated to include the surface
area of the cell,40 acres from the crest line perimeter,plus a portion of the top surface of the dikes.When Cell
4B was added to the estimate,the surface area for both of the cells,including a portion of the top surface of the
dikes,was calculated at 41 acres,or 1,785,960 ft'.The reduction in the total area for Cell 4A was because a
portion of the top surface of the common dike between the cells was allocated to the area calculated for Cell 4B.
Each of the cells is now calculated at 41 acres,or 1,785,960 ft'.
