Re: State of Utah Ground Water Discharge Permit No, UGW370004 (the
White Mesa Uranium Mill - Notice Pursuant to Part LG.l(a)
Dear Mr. Finerfrock:
'GWDP")
The White Mesa uranium mill (the "Mill") perfonned momlily accelerated groundwater
monitoring of MW-14. MW-26 and MW-32 on January 12 and 13. 2010 under the March 17,
2008 version of the GWDP (the "Previous GWDP"), prior to its revision on January 20, 2010.
The final analytical results of these samplings are contained in an analytical report dated
February 5, 2010.
Pursuant to Part l.GT .a) of the Previous GWDP, please take notice that the concentrations of the
following constituents in the following monitoring wells sampled on January 12 and 13 of 2010
exceeded their respective ground water compliance levels ("GWCLs") in Table 2 of the Previous
GWDP:

As confirmed via email correspondence on February 16 and 17, 2010, as a result of the issuance
of the modified GWDP on January 20, 2010 (the "Current GWDP"), which sets revised GWCLs,
all requirements to perform accelerated monitoring under Part I.G.I of the Previous GWDP
ceased effective on January 20, 2010. and the effect of the issuance of the Current GWDP was to.
create a "clean slate" for all constituents in all wells going forward.
This means that no accelerated monitoring is required under the Current GWDP for the first
quarter of 2010. Accelerated monitoring for subsequent quarters will depend on the application
of Part T.G.I of the Current GWDP to results from groundwater samples required to be taken in '
the first quarter of 2010 and front any subsequent sample results. The notice requirements of
Part l.G.l.a) of the Current GWDP will apply to any exceedances observed in groundwater
samples required to be taken in the first quarter of 2010 and from any subsequent sample resuhs.
Accordingly, the January 12 and 13 accelerated monitoring samples were not required to be
performed under die Current GWDP; hence this is a Notice under the Previous GWDP, and the
results are compared to the GWCLs in the Previous GWDP.
