Harold,
Dane has asKed me to respond to your email from October 22, which included PDF copies of a DUSA October 22, 2009 letter, a
June 17, 2009 DRC email, and a Microsoft Project chart of a Cell 4B construction schedule.
TTie purpose of my email Is to let you know that the Division is not opposed to certain preliminary construction activities at Cell 4B
that can be done at your own risk without prior Radioactive Material License (License) or Ground Water Discharge Permit (Permit)
approval. "Uiese preliminary activities include: grubbing, site excavation, well abandonment (in accordance with State Engineer
requirements), blasting, and rock excavation.
Certain other construction activities must not be undertaken without pnor License or Permit approval, including constnjction of:
liners, leak detection systems, fluid conveying systems, and dikes.

Attached is a letter confirming our intent to proceed with the earthworlt portion of the Cell 48 tailings cell based on earlier
comments from DRC staff. We briefly discussed this issue dunng our meeting at the Capital on October 8*. I will contact you
Monday to discuss the attached letter and to confimi your concurrence with the earlier DRC comments.
