Dear Ms. Tischler,
Pursuant to the RML, Energy Fuels Resources (USA) Inc. (EFR) submitted to the Division of
Radiation Control (DRC) the annual surety estimate on March 2,2012 and a revised estimate on
September 14,2012. The Director has reviewed the submittals and approves the surety amount of
$21,126,149. This is an increase of $825,535 from the currently funded $20,300,614.
In a letter dated September 25, 2012, EFR committed to increase the Contingency line item in the
Surety from 15% to 20% of direct costs starting with the 2013 surety submittal (due May 4,2013),
and to 25% of direct costs in the 2014 surety submittal (due May 4,2014). EFR committed to
these increases to answer DRC concerns over conditions both unknown and un-quantified at this
time. This action satisfies the requirements found in NUREG-1757, Volume 3, pages 4-9 through
4-10, which was incorporated in Rule R313-22-35(3)(g) by reference in December of 2003 that
the contingency line item be funded at least at 25% of direct costs. The DRC acknowledges the
increase of this line item to 20% of direct costs in the 2013 surety.
Please submit an updated 2013 surety instrument in the amount of $21,126,149. Please provide
this evidence within 60 calendar days of receipt of this approval letter.
