Howard Director December 9, 2019 Kathy Weinel, Quality Assurance Manager Energy Fuels Resources (USA) Inc. 225 Union Blvd., Suite 600 Lakewood, CO 80228 RE: White Mesa Uranium Mill Revised Spill Prevention, Control, and Countermeasures Plan and Revised Stormwater Best Management Practices Plan Utah Groundwater Discharge Permit No. UGW370004 Dear Ms. Weinel: The Division of Waste Management and Radiation Control (DWMRC) has reviewed the Energy Fuels Resources (USA) Inc. (EFR) October 14, 2019 Transmittal of Revised Spill Prevention, Control, and Countermeasures Plan (SPCC) and Revised Stormwater Best Management Practices Plan (SWBMPP) for the White Mesa Uranium Mill. The EFR transmittal includes redline strikeout and clean versions of each document. Per the EFR transmittal the revisions include changes made to: 1. Update personnel and contact information; 2. Correct typographical errors, and; 3. Update drainage information for Cell 2. DWMRC notes that the Mill Personnel and the Lakewood Co. personnel and contact information was updated. DWMRC notes that drainage information in Sections 3.0 and 4.0 of the SPCC were updated to accurately reflect basin areas (as shown on Figure 2 of the SWBMPP), drainage directions and containment locations (for drainage in the restricted area). In addition to these items listed by EFR, the DWMRC noted that Table 4 of the SPCC (Reagent Yard/Small Quantity Chemicals List) was eliminated in the EFR transmittal. DWMRC contacted EFR personnel by e-mail on December 2, 2019 as to why this elimination was made and per the EFR e-mail response on December 3, 2019, “those chemicals are either no longer on hand or are stored elsewhere, anything stored elsewhere is noted on the appropriate table.” (Over) Based on the review and follow up e-mail correspondence, it appears that all of the changes made were appropriate and the Revised October 14, 2019 SPCC and SWBMPP are hereby approved.
