Installation of Additional Nitrate Monitor Wells Confirmatory Action Letter. Dear Ms. Weinel: The Division of Waste Management and Radiation Control (DWMRC) and Energy Fuels Resources (USA), Inc. (EFR) had a conference call on February 2, 2021 to discuss preliminary findings of the DWMRC’s review of the 3rd Quarter, 2020 Nitrate Groundwater Monitoring Report. In the meeting, both parties acknowledged that the nitrate concentrations observed in monitoring well TWN-7 has exceeded the State of Utah 10 mg/L groundwater quality standard. Due to the lack of information to the west and southwest of the well, EFR agreed to install two additional monitoring wells. EFR committed to the following: 1) Two additional monitoring wells will be installed. One well west and downgradient of well TWN-7 and one well southwest of TWN-7 to further define the boundaries of the nitrate contaminate plume and ground water flow directions. 2) On or before April 1, 2021 EFR will provide for DWMRC approval the proposed locations of the two new wells mentioned above and a schedule when these wells will be drilled and installed. Please respond in writing within three calendar days of receiving this letter if you disagree with the above agreed upon resolution or schedule. (Over) Thank you for your cooperation.
