Utah Groundwater Discharge Permit No. UGW370004 Dear Ms. Weinel:
The Division of Waste Management and Radiation Control (DWMRC) has completed review of the
Energy Fuels Resources (USA) Inc. (EFRI), April 23, 2021, State of Utah Ground Water Discharge
Permit No. UGW370004 White Mesa Uranium Mill – Removal of Certain Groundwater Monitoring Parameters from Accelerated Monitoring Status. EFRI requests that certain monitoring well parameters be returned to baseline monitoring as listed on the
table below:

*Per a March 15, 2021 DWMRC letter regarding review of the Plan and Time Schedule for MW-26 it
was noted that the MW-26 TDS exceedances were due to laboratory error and that confirmation of
return to compliance through the 1st Quarter 2021 would suffice for return to baseline monitoring frequency. (Over)
It was noted in review of groundwater monitoring data, including laboratory data sheets included with
the April 23, 2021 EFRI Request, that MW-28 Gross Alpha had sample results below the Permitted
Ground Water Compliance Limits (GWCLs) for the most recent eight consecutive accelerated sampling events; and that MW-26 TDS results for the 1st Quarter 2021 were below the groundwater compliance limit. In accordance with past DWMRC protocols, accelerated monitoring may be discontinued if at least eight consecutive samples show concentrations below the GWCL, which is the case for MW-28 Gross Alpha. In DWMRC review of TDS in MW-26, the exceedances were due to laboratory error,
which has been resolved as demonstrated by the 1st Quarter 2021 sample results. Therefore, the request to return to baseline monitoring for the wells and parameters listed on the previous table is hereby approved.
