RE: Request for Extension - License Condition 11.3.A Radioactive Material License No. UT 1900478 Dear Ms. Weinel:
In a letter dated November 19, 2018, Energy Fuels Resources (USA) Inc. (EFRI) requested a 14-day extension to the requirements found in License Condition 11.3.A which states: “The licensee shall maintain all leak detection system piping, including any access pipes, open, fully functional and free of soil, debris or detritus. All access pipes shall be capped to prevent inflow of rainwater, soil, debris or
detritus when not in use for monitoring or pumping. The licensee shall conduct annual video logs of all
access pipes to demonstrate the physical condition of the system. In the event that the licensee
determines any access pipe is blocked, partially blocked or otherwise not fully functional, the licensee shall: 1) remove all blockages within 14 calendar days of discovery, and 2) submit a written report for Director approval within 30 calendar days of discovery.”
As described in the November 19, 2018 letter, on November 6 and 7, 2018, EFRI completed the video log of the leak detection systems access pipes and found them operational but some material (including rodent nests) was observed that needs to be cleaned out. Due to scheduling conflicts and the Thanksgiving holiday, EFRI is unable to schedule a contractor to clean out the pipes within the 14-day requirement. Therefore, EFRI has requested an extension to the requirement with the work to be
completed by December 7, 2018 and the report to be submitted by January 18, 2019. The Division of Waste Management and Radiation Control has completed its review of this request and finds it reasonable, in that, it will not have an adverse effect to public health and safety or the environment. Therefore, the extension request is granted in accordance with the terms proposed in the
