Dear Ms. Weinel: The Division of Waste Management and Radiation Control has completed its review of the Energy Fuels
Resources (EFR) August 28, 2018 Transmittal of Plan and Time Schedule under Utah Ground Water
Discharge Permit UGW370004 Part I.G.4(c) White Mesa Mill (EFR Plan). The EFR Plan addresses exceedances of the Ground Water Compliance Limit (GWCL) for uranium in monitoring well MW-30. Monitoring Well MW-30 is in out-of-compliance status for uranium per the Permit Part I.G.2. Uranium is therefore required to undergo corrective action in accordance with Part I.G.4 of the Permit.

The table below summarizes the preliminary findings in the EFR Plan:

•The background report also noted a decreasing pH trend. Increases in concentrations of selenium and uranium in MW-30 have been attributed to decreasing pH trends in previous Source
Assessment Reports (SARs) for MW-30 (SAR
dated October 10, 2012 and pH Report dated November 2012). • Monitoring well MW-30 is located at the margin of the nitrate/chloride plume.

A Source Assessment Report, which will include a more specific source investigation and statistical
analysis in accordance with Section 4 of the EFR Plan, must be submitted to the Director within 90 days after approval of the EFR Plan. Based on the Division’s review, the planned activities are appropriate. The EFR Plan is hereby
