Re: Transmittal White Mesa Uranium Mill Reclamation Plan, Revision 5.1
Dear Mr. Anderson:
Pursuant to discussions with the Division for Waste Management and Radiation Control
("DWMRC") regarding the draft Stipulation and Consent Agreement ("SCA", dated July 1,
2016) for the Cell 2 cover placement activities, Energy Fuels Resources (USA) Inc. ("EFRI")
provided the DWMRC with the White Mesa Uranium Mill Reclamation Plan, Revision 5.1
("Reclamation Plan") on August 10, 2016. DWMRC provided written review comments to EFRI
on both documents, including draft redlines on the SCA on September 28, 2016. EFRI revised
the SCA and select sections of the Reclamation Plan to address DWMRC's review comments
and also incorporate comments resulting from discussions with the DWMRC during a meeting
on October 5, 2016 and during follow up conference calls. Select sections of the Reclamation
Plan and SCA were submitted on November 11, 2016 to incorporate the above referenced
comments. DWMRC provided verbal comments to the November 11, 2016 revisions in a
conference call on November 16, 2016. EFRI provided redlined sections of the Reclamation Plan
and draft SCA to DWMRC on December 5, 2016 to address the verbal comments provided by
DWMRC in the November 16, 2016 conference call. DWMRC notified EFRI on January 3, 2017
that all EFRFs December 5, 2016 redlines for the SCA were accepted and provided additional
(minor) redlines to the SCA to EFRI. EFRI notified DWMRC on January 9, 2017 that they
accepted DWMRC’s January 3, 2017 SCA redlines. DWMRC notified EFRI verbally on
February 6, 2017 that they had no further planned redlines to the SCA except for minor editorial
changes. EFRI reviewed the SCA redlines made after the December 5, 2016 submittal of the
Reclamation Plan, Revision 5.1, and determined that no further revisions to Reclamation Plan
5.1 were required. The date for the document is December 2016. The previous cover letter
transmitting the Reclamation Plan, Revision 5.1 was dated December 5, 2016 and is considered
the date of the final version of this report. Replacement pages for the Reclamation Plan,
Revision 5.1 were provided to DWMRC on December 5, 2016, however they are being provided
again with some minor copying changes to make for easier replacement into the August 2016
version of the document. In addition, new CDs are being provided that only contain the final pdf
of the Reclamation Plan. Previous CDs included copies of the redlined SCA, redlined sections
of the Reclamation Plan, and the final pdf.
