Anderson Director September 9,2015 Kathy Weinel Quality Assurance Manager Energy Fuels Resources (USA) Inc. 225 Union Blvd., Suite 600 Lakewood, CO 80228 RE: Notification Requirements for Department of Transportation Incidents Radioactive Material License Number UT 1900479 Dear Ms. Weinel: On August 21,2015, the Division of Waste Management and Radiation Control received a report of an incident involving a roll-off box being released from the White Mesa Uranium Mill's restricted area that did not meet U.S. Department of Transportation (DOT) standards. During the Division's investigation of this reported incident, a second incident was identified involving a shipment of I Ie.(2) material arriving at the White Mesa Uranium Mill (the Mill) for disposal in a roll-off box. According to information provided by the Mill, the roll-off box had leaked a portion of the lle.(2) shipment during its transport to the Mill. However, the Mill did not report this leaking container. This letter constitutes an administrative action in accordance with R313-14-15(5) of the Utah Administrative Code. Please note the following requirements to notifr the Division of DOT incidents. 1) U.S. Department of Transportation (DOT) Regulations as adopted by the Division (see R3l3-19- 100 of the Utah Administrative Code, Transportation). 2) DOT notification requirements, 49 CFR 171.15(a) and (b) [see R313-19-100(a)(i)(D) of the Utah Administrative Codel. It is the Mill's responsibility to inform the Division of any DOT incidents in accordance with the notification requirements referenced above. For further clarification, these DOT notification requirements will be added to License Condition 9.2 of your Radioactive Materials License (UTl900479) in a future license amendment.
