This report is also an evaluation of potential remedial action to restore and maintain groundwater quality to ensure that Groundwater Discharge Permit (“GWDP”) limits will not be exceeded at the compliance monitoring point and that, to the extent applicable, discharge minimization technology and best available technology will be re-established. Energy Fuels Resources (USA) Inc. (“EFRI”) believes that the consecutive exceedances of gross alpha in MW-32 are likely due to background influences and a small and unrepresentative background data set used to calculate the GWCLs at the time of the Background Reports. Given the recent analyses in the Background Reports (INTERA, 2007, 2008), the University of Utah study (Hurst and Solomon, 2008), and other recent analyses and investigations at the site, including the analyses presented in this SAR, there is no indication that the exceedances of gross alpha in MW-32 are due to Mill-related impacts or to any potential tailings seepage. The results of the geochemical analysis of gross alpha in MW-32 demonstrate that the exceedances in MW-32 can be attributed to natural background. Indicator parameter analysis demonstrates that there are no significant increasing trends in chloride, fluoride, or sulfate concentrations, and uranium concentrations are exhibiting a significantly decreasing trend. Therefore, a revised GWCL has been proposed in this report. (“EFRI”) operates the White Mesa Uranium Mill (the “Mill”), located near Blanding, Utah (Figure 1), under State of Utah Groundwater Discharge Permit UGW370004 (the “GWDP”). This is the Source Assessment Report (“SAR”) required under Part I.G.4 of the GWDP relating to violations of Part I.G.2 of the GWDP with respect to gross alpha in groundwater at compliance monitoring well MW-32 (Figure 1). Part I.G.2 of the GWDP provides that out-of-compliance status exists when the concentration of a constituent in two consecutive samples from a compliance monitoring point exceeds a groundwater compliance limit (“GWCL”) in Table 2 of the GWDP. The GWDP was originally issued in March 2005, at which time GWCLs were set on an interim basis, based on fractions of State of Utah Ground Water Quality Standards (“GWQSs”) or the equivalent, without reference to natural background at the Mill site. The GWDP also required that EFRI prepare a background groundwater quality report to evaluate all historical data for the purposes of establishing background groundwater quality at the site and developing GWCLs under the GWDP. As required by then Part I.H.3 of the GWDP, EFRI submitted the following to the Director (the “Director”) of the Utah Division of Radiation Control (“DRC”) (the Director was formerly the Executive Secretary of the Utah Radiation Control Board and the Co-Executive Secretary of the Utah Water Quality Board): • A Revised Background Groundwater Quality Report: Existing Wells for Denison Mines (USA) Corp.’s Mill Site, San Juan County, Utah, October 2007, prepared by INTERA, Inc. (the “Existing Wells Background Report”). • A Revised Addendum: Evaluation of Available Pre-Operational and Regional Background Data, Background Groundwater Quality Report: Existing Wells for Denison Mines (USA) Corp.’s Mill Site, San Juan County, Utah, November 16, 2007, prepared by INTERA, Inc. (the “Regional Background Report”). • A Revised Addendum: Background Groundwater Quality Report: New Wells for Denison Mines (USA) Corp.’s Mill Site, San Juan County, Utah, April 30, 2008, prepared by INTERA, Inc. Based on a review of the Background Reports and other information and analyses, the Director re-opened the GWDP and modified the GWCLs to be equal to the mean concentration plus two standard deviations or the equivalent. The modified GWCLs became effective on January 20, 2010. A Plan and Time Schedule for the second quarter of 2013 (“Q2 2013 Plan and Time Schedule”) covering gross alpha in MW-32, which was identified as being in violation of Part I.G.2 of the Permit, was submitted on September 20, 2013, and approved by DRC in correspondence dated October 8, 2013. This SAR addresses gross alpha in MW-32 as described in the DRC-approved Q2 2013 Plan and Time Schedule. 1.1 Source Assessment Report Organization This SAR follows a similar format to the October 2012 SAR and all previously submitted SARs. A description of the approach used for analysis is provided in Section 2.0, and the results of the analysis are presented in Section 3.0. Conclusions and recommendations are reviewed in Section 4.0, and references are included in Section 5.0. The appendices consist of the analyses performed for this assessment and are organized in the following manner: Appendix A contains a table showing exceedances. Appendix B contains the geochemical analysis performed on gross alpha in MW-32. Appendix C contains the indicator parameter analysis performed on chloride, fluoride, sulfate, and uranium in MW-32. Appendix D contains data plots for gross alpha and indicator parameters in MW-32 using all available data to date compared to the data plots from the Background Reports. Appendix E contains the Flowsheet developed based on the United States Environmental Protection Source Assessment Report for Gross Alpha in MW-32 White Mesa Uranium Mill Blanding, Utah 3 January 13, 2014 Agency’s (“USEPA”) Statistical Analysis of Groundwater Monitoring Data at RCRA Facilities, Unified Guidance (USEPA, 2009), and was approved by DRC prior to completion of the Background Reports. Appendix F is included on the compact disc that accompanies this SAR and contains the electronic input and output files used for statistical analysis. 2.0 CATEGORIES AND APPROACH FOR ANALYSIS Generally, out-of-compliance constituents and wells can be grouped into five categories: 1. Constituents in wells with previously identified rising trends. 2. Constituents in pumping wells. 3. Constituents potentially impacted by decreasing trends in pH across the site. 4. Newly installed wells with interim GWCLs. 5. Other constituents and wells. This SAR addresses one constituent in one well (gross alpha in MW-32), which falls into category five. MW-32 was installed in 2002, at which time a limited round of sampling and analysis was completed. In 2005, quarterly sampling and analysis of the well began. In 2007, at the time of the background evaluation for MW-32, there was a relatively small amount of data for MW-32 (around eight data points for most constituents). Since the time of the Background Reports, data have continued to be collected, with 42 sample results for gross alpha in MW-32 available at the time of this SAR. 2.1 Approach for Analysis The first step in the analysis is to perform an assessment of the potential sources for gross alpha to determine whether the exceedance is due to background influences or Mill activities. If the exceedance is determined to be caused by background influences, then it is not necessary to perform any further evaluations on the extent and potential dispersion of the contamination or to perform an evaluation of potential remedial actions. Monitoring will continue, and where appropriate, a revised GWCL will be proposed to reflect changes in background conditions at the site. Background at the Mill site was recently thoroughly studied in the Background Reports and in the University of Utah Study (Hurst and Solomon, 2008). Both the Background Reports and the University of Utah Study concluded that groundwater at the site has not been impacted by Mill operations. Although MW-32 was not analyzed in the University of Utah study, the research was conducted on wells carefully selected to represent groundwater at the site. The University of Source Assessment Report for Gross Alpha in MW-32 White Mesa Uranium Mill Blanding, Utah 4 January 13, 2014 Utah study concluded that the majority of groundwater at the site is older than the age of the Mill (Hurst and Solomon, 2008), indicating no mill-related impacts to groundwater. Both of those studies also acknowledged that there are natural influences at play at the site that have given rise to increasing trends and general variability of background groundwater at the site. As discussed in detail in Section 9.0 of the Existing Wells Background Report, chloride is the best indicator of potential tailings cell seepage, followed by fluoride and then sulfate (due to mobility and abundance in tailings). Uranium is probably the most mobile of trace (metal) elements and is the best indicator parameter for metals and radionuclides. Any potential seepage from tailings impoundments would be expected to exhibit rising concentrations of chloride followed by fluoride, sulfate, and uranium. While uranium may be the most mobile of trace (metal) elements, it is typically retarded behind chloride, fluoride, and sulfate, and would likely not be expressed in groundwater until sometime after chloride, fluoride, and sulfate concentrations had begun to rise. This is because uranium is a metal cation and behaves as other metals with respect to pH. It is important to note, however, that while the absence of a rising trend in chloride would indicate that there has been no impact from tailings, a rising trend in chloride, as well as in other indicator parameters, could also be due to natural influences (see Section 12.0 of the Existing Wells Background Report). Therefore, in situations where there is a significant rising trend in chloride or in other indicator parameters, other evaluations would need to be performed regarding the behavior of the other indicator parameters and whether or not the concentrations and mass balance indicate potential tailings cell seepage. The assessment of potential sources of gross alpha in MW-32 was accomplished by performing a geochemical analysis to evaluate the behavior of the constituents in the well to determine if there have been any changes in the behavior of indicator parameters, such as chloride, sulfate, fluoride, and uranium, since the date of the Background Reports that may suggest a change in the groundwater conditions at that well. The geochemical analysis of gross alpha and the indicator parameters in MW-32 was supported by a statistical analysis that followed the process outlined in the Groundwater Data Preparation and Statistical Process Flow for Calculating Groundwater Protection Standards, White Mesa Mill Site, San Juan County, Utah (“Flowsheet”) (INTERA, 2007), a copy of which is attached as Appendix E. The Flowsheet was designed based on USEPA’s Statistical Analysis of Groundwater Monitoring Data at RCRA Facilities, Unified Guidance (USEPA, 2009), and was approved by DRC prior to completion of the Background Reports. 2.2 Approach for Setting Revised GWCLs If the foregoing approach results in the conclusion that the previous analysis in the Background Reports has not changed, or that the out-of-compliance status of gross alpha in MW-32 is due to Source Assessment Report for Gross Alpha in MW-32 White Mesa Uranium Mill Blanding, Utah 5 January 13, 2014 natural variations in background conditions that were not captured in the small data-set at the time of the Background Reports, then a new GWCL will be proposed for the constituent in accordance with the DRC-approved Flowsheet. 3.0 RESULTS OF ANALYSIS This section describes the results of the analysis, summaries of which are provided in Appendix B-1, Appendix C-1, and Appendix D. 3.1 Gross Alpha in MW-32 Gross alpha concentrations collected from MW-32 between 2002 and July of 2013 were analyzed following the steps outlined in the Flowsheet. Data used in the analysis are presented in Appendix B-5 and as input files included in Appendix F (electronic-only). Two results were removed from the analysis (Appendix B-6) due to an insensitive detection limit and an extreme outlier identified in the box and whisker plot (Appendix B-7), which was likely the result of a decimal transcription error, leaving 42 individual results for gross alpha in MW-32. Gross alpha concentrations in MW-32 are normally or lognormally distributed (Appendix B-8) and do not exhibit a significantly increasing trend (Appendix B-9). Appendix D presents linear regression plots for gross alpha in MW-32 at the time of the Background Reports and at the time of this SAR. At the time of the Background Reports, eight individual results were used, distribution was normal, and there was a downward trend. Although the trend line in the most recent plot appears to be increasing, the fit to the line is poor (r2= 0.0387), and the p value is greater than 0.05, indicating that the apparent trend is not significant at the 95% confidence level. The differences noted in the Background Reports data set and the current SAR data set can be attributed to the increase in the data sets used for analysis. 3.2 Indicator Analysis A summary of the Flowsheet analysis for indicator parameters is presented in Appendix C-1. Appendix C-2 presents the descriptive statistics for the indicator parameters. Data used in the analysis is presented in Appendix C-3, while data omitted from analysis are presented in Appendix C-4. Graphs used in the analyses presented in Appendix C-5 include: box and whisker plots used to identify extreme outliers, histograms and the Shapiro-Wilk test used to determine distribution, and linear regression plots used to identify significant trends in normally or lognormally distributed data; however, plots are included for all parameters regardless of their distribution. Mann-Kendall trend analyses for parameters that were not normally or lognormally distributed are included in Appendix C-8. Chloride, fluoride, and sulfate concentrations in MW-32 are not exhibiting significant trends. Uranium is exhibiting a significantly decreasing Source Assessment Report for Gross Alpha in MW-32 White Mesa Uranium Mill Blanding, Utah 6 January 13, 2014 trend. A comparison of current indicator parameter plots with plots from the Background Reports (Appendix D) shows that there are some differences in the two sets of plots. Linear regression plots for chloride show a decreasing trend at the time of the Background Reports, compared to a slightly increasing trend at the time of this SAR. Conversely, sulfate concentrations were significantly increasing at the time of the Background Reports, while at the time of this SAR, the trend line is slightly decreasing. The differences in the plots are most likely caused by the small data sets at the time of the Background Reports, which did not fully capture the background conditions in MW-32. The differences in the plots also highlight the dynamic and variable groundwater system that is naturally occurring at the site. Indicator parameter analysis results support the conclusion of the gross alpha analysis that the groundwater conditions in this well are not consistent with potential tailings cell seepage. 3.3 Proposed Revised GWCL for Gross Alpha in MW-32 The reasons discussed above support the conclusions that (1) MW-32 is not being impacted by any potential tailings cell seepage, and (2) gross alpha concentrations in MW-32 are the result of background that was not fully captured in the small sample size used for background analysis. A new GWCL for gross alpha is therefore proposed as follows: • MW-32: The current GWCL is 3.33 picocuries per liter (pCi/L). In accordance with the Flowsheet, the proposed revised GWCL is 7 pCi/L, which is the mean + 2σ, based on all data available to date. It should be noted that the proposed revised GWCL for gross alpha in MW-32 is lower than the fractional approach for Class III wells (7.5 pCi/L) and the GWQS (15 pCi/L), which are both protective of human health and the environment. 4.0 CONCLUSIONS AND RECOMMENDATIONS Background groundwater conditions at the Mill site were recently thoroughly studied in the Background Reports and in the University of Utah Study. Both the Background Reports and the University of Utah Study concluded that groundwater at the site has not been impacted by Mill operations. Both of those studies also acknowledged that there are natural influences at play at the site that have given rise to increasing trends and general variability of background groundwater conditions at the site. The focus of this SAR was therefore to identify any changes in the circumstances identified in those studies. A geochemical analysis for the indicator parameters in MW-32 was performed. The results of the analysis show that the exceedances of gross alpha in MW-32 are not due to potential tailings cell seepage. This is evident from the behavior of indicator parameters in Source Assessment Report for Gross Alpha in MW-32 White Mesa Uranium Mill Blanding, Utah 7 January 13, 2014 MW-32, which are not showing any significant upward trends. As a result, INTERA concludes that the exceedances of gross alpha in MW-32 are due to the small sample size of the data used at the time of the Background Reports. Table 2 summarizes the findings of this analysis.
