Dear Ms. Tischler:
The Utah Division of Radiation Control ("DRC") has reviewed Energy Fuels Resources (USA), Inc.
("EFR") July 29, 2013 letter response to DRC February 14, 2012 Confirmatory Action Letter. Based on
our review the proposed actions are conditionally approved with the following conditions:
1) The new wells will be designed and constructed in accordance with Part I.E.4 of the EFR Ground
Water Quality Permit (Permit).
2) As-Built report for new wells will comply with the requirements of Part I.F.6 of the Permit.
3) The initial sampling of the new monitoring wells will be conducted in accordance with the EFR
Quality Assurance Plan (QAP).
4) EFR will give DRC a 14 day notice prior to the installation of the new wells.
After the investigation of the nitrate exceedances in these wells are complete. The DRC will consider
incorporating the required corrective actions with the approved Nitrate Corrective Action Plan. Please
respond in writing with in three calendar days of receiving this letter if you disagree with the above
additional actions.
