HomeMy WebLinkAboutDRC-2012-001975 - 0901a0688030cb29DRC-2012-001975 Energy Fuels Resources IU5R) Inc August 14, 2012 VIA E-MAIL AND OVERNIGHT DELIVERY Mr Rusty Lundberg Director Utah Division of Radiation Control 195 North 1950 West PO Box 144850 Salt Lake City, UT 84114-4850 Re Request to Amend State of Utah Groundwater Discharge Permit No, UGW370004 for the White Mesa Uranium Mill (the "Mill") to change the name of Denison Mines (USA) Corp to Energy Fuels Resources (USA) Inc Dear Mr Lundberg This letter constitutes Energy Fuels Resources (USA) Inc's ("EFR's") request to amend the Mill's Groundwater Discharge Permit No UGW370004 (the "Permit") to change the name of the Permittee from Denison Mines (USA) Corp to Energy Fuels Resources (USA) Inc Energy Fuels Resources (USA) Inc (previously named Denison Mines (USA) Corp) (the "Permittee") operates the Mill, located approximately six miles south of Blanding, Utah The Mill processes natural (native, raw) uranium ores and altemate feed materials The Mill operates under the most current revision of the above-named Permit, issued by the Utah Division of Radiation Control ("DRC"), which became effective on August 8, 2012 (although the DRC Director's signature on the permit was erroneously dated August 7"", 2011), and which is currently in Timely Renewal status A summary of facts relevant to the above changes is provided below Each of the following facts was explained to Mr John Hultquist and Ms Gwyn Galloway of DRC on June 27, 2012 • The Permittee was and still is owned by Energy Fuels Holdings Corp (previously named Denison Mines Holdings Corp ) ("DMHC") • Energy Fuels Inc ("EFl") acquired DMHC on June 29, 2012 As of that date, EFl acquired 100% of DMHC's United States holdings including the Mill located in San Juan County, Utah • DRC staff concurred that the above transaction constituted an indirect transfer of control of Radioactive Materials License No 1900479 (the "License") and the Permit DRC provided a letter on June 27, 2012 approving the indirect transfer of control of the License and the Permit • EFl changed the name of the Licensee to Energy Fuels Resources (USA) Inc , and the name of DMHC to "Energy Fuels Holdings Corp ", both effective July ^25, 2012 Letter to Director August 14, 2012 Page 2 of 2 • The office address of the Permittee will change on August 20, 2012 to Energy Fuels Resources (USA) Inc 225 Union Boulevard, Suite 600 Lakewood, CO 80228 The Permittee submitted an application for renewal of the Permit on September 1, 2009 and a revised application, at the request of DRC, on July 13, 2012 As mentioned above, the July 2012 application for renewal is currently undergoing review by DRC, and the Permit is in Timely Renewal status Denison's change of name became effective on July 25, 2012, that is, 12 days after Denison's submittal of the application for renewal of the Permit Now that the change of name is in effect, EFR requests that DRC change the name of the Permittee on the Permit, either during the upcoming permit renewal, or at your convenience Please contact me if you have any questions or require any further information regarding this request Yours very truly, ENERGY FUELS RESOURCES (USA) INC.
