This letter acknowledges and confirms changes to the schedule for completion of construction of
the above-captioned catchment
History
On Apnl 12, 2012 the Utah Division of Radiation Control (DRC) received through email a single-
sheet plan for an improvement to the existing NDP recirculation pump at the Energy Fuels
Resources (EFR) White Mesa Uranium Mill At the time, the owner of the mill was the Denison
Mines (DUSA) The plan sheet accompanied an Apnl 12, 2012 DUSA response to the Notice of
Violation and Compliance Order (Order), Docket No UGW 12-01, dated March 7, 2012 The
design drawing responded to Violation No 5, where DUSA failed to control contact wash water at
the New Decontamination Pad near the scale house The DRC observed this violation dunng an
October 18, 2011 DRC inspection where DRC Staff noted leakage to the ground fi-om the New
Decontamination Pad recirculation pump system
On Apnl 18, 2012, the DRC extended a conditional approval of the NDP recirculating pump
catchment At the time the DRC understood that DUSA intended to complete constmction of the
catchment within 15 calendar days of approval of the constmction plan On August 13, 2012, EFR
contacted the DRC to report that constmction had not been completed as of that date, but that

constmction would commence immediately EFR now expects to complete constmction by
August 31, 2012 EFR followed the August 13, 2012 telephone conversation with a wntten notice
on August 14, 2012
Dunng the time between receiving plan approval and the August 13, 2012 telephone conversation
with the DRC, the mill was offline for scheduled maintenance until the week of August 6, 2012
In addition to the scheduled maintenance activities, the maintenance crews also performed
cleanup of the sulfunc acid release fi-om the Clancone failure, decommissioning and removing the
Clancone in the process
Confirmatory Action
EFR committed to the following actions in its August 14, 2012 letter, with which the DRC
concurs
1 EFR will complete constmction of the catchment by August 31, 2012, and
2 EFR will notify the DRC when constmction is completed to allow the opportunity for
inspection, and
3 EFR will submit As-Built drawings, including specifications of the matenals used, withm
30 calendar days after completion of constmction
