Dear Mr Lundberg
This letter documents Energy Fuels Resources (USA) Inc's ("EFR's") August 13, 2012 discussion with
Mr Russ Topham of the Division of Radiation Control regarding construction of spill collection
improvements to the New Decontamination Pad ("NDP") recirculation pump
Drips from the NDP recirculation pump were the subject of Violation No 5 in DRC's Notice of Violation
("NOV") and Compliance Order UGW 12-01, dated March 7, 2012, resulting from DRC's October 8,
2011 stormwater inspection at the White Mesa Mill EFR responded to Violation No 5 by submitting a
single-sheet drawing for improvements to collect the drips from the recirculation pump The drawing was
approved in DRC's letter of April 18, 2012, which EFR received on April 25, 2012
The Mill's maintenance department has focused on
• response to and cleanup of the spill resulting from the Claricone failure during April and May,
2012, followed by
• equipment cleanouts and repairs required for restart of the Mill on conventional ore, which
restarted in July 2012
The Mill notified Corporate Environmental staff on August 13, 2012, that construction of the NDP pump
improvements had not been completed EFR contacted Mr Topham on August 13, 2012 to identify that
the construction has been scheduled, but has not been completed, and to commit that

2 As required by DRC's April 18, 2012 letter, EFR will notify DRC when construction is complete,
to permit DRC an early opportunity for inspection of the installation

3 As required by DRC's April 18, 2012 letter, EFR will submit As-Built drawings, including
specifications of the matenals used for construction, to DRC withm 30 days after completion of
construction
Mr Topham requested that EFR prepare this letter to update the commitment dates and confirm our
discussion
