(hereafter "DUSA") White Mesa Uranium Mill, near Blanding, Utah The Division of Radiation Control (hereafter "DRC") has reviewed 4^*^ Quarter 2011 Chlorofonn Monitoring Report (hereafter "Report") for the Chloroform Contamination hivestigation. For the review ofthis report the following regulatory enforcement documents were used: • DUSA was issued Ground Water Quality Discharge Permit No. UGW370004 (hereafter "Permit") on March 8, 2005; last revised on January 20, 2010 • The DUSA Quality Assurance Plan (hereafter "QAP") March 22, 2010 (Revision. 6.0) Review The Report appeared to be in compliance with the Permit and QAP with the exception of not meeting the requirements found in sections 4.3.3 and 9.4.1(a) of the QAP. These sections of the QAP requires: 1.0 ''433. Field Duplicates One Duplicate set of samples submitted with each Batch (defined in Section 4.3 4) of samples (DTG, Field and Laboratoiy Quality Assurance/Oualit} ' Control, 7.8), taken from one ofthe wells being sampled and will be submitted to the Analytical Laboratoiy and analyzed for all contaminants listed in Table 2 of the GWDP (EPA SW-846, Chapter J,Section 3.4 1). 4.3.4. This is a violation of Section 8.2 and Table 1 of the QAP. The remaining 12 samples, including TW4-70 (the duplicate for TW4-6), were analyzed within the required holding time required for VOCs. The sample for TW4-3 and its duplicate sample TW4-65 were among the samples that meet the required holding times and meet the requirement in Section 4.3.3 of the QAP. DUSA appropnately resampled for the 15 samples with holding time problems for VOCs; however, DUSA failed to collect a duplicate sample for the fifteen samples that were re- collected and analyzed in December 2011. This is a violation of Section 4.3.3 of the QAP. 2.0 "9.1 4 (a) Relative Percent Difference. RPDs will be calculated in comparisons of duplicate and original field sample results. Non-conformance will exist when the RPD > 20%, unless the measured activities are less than 5 times the required detection limit (Standard Methods, 1998) (EPA Contract Laboratoiy Program National Functional Guidelines for Inorganic Data Review, Februaiy 1994, 9240.1-05-01, p. 25). " Tlie chloroform analytical results comparison between the sample for TW4-6 and its duplicate sample TW4-70 RPD >20% is as follows: Parameter GWQS T\V4-6 TW4-70 RPD Chloroform 70 ng/L 21 Ug/L 50 ng/L 81 DUSA explained how they will prevent the problems of sections 4.3.3 and 9.1.4 (a) in the future in Section 6.1 (Corrective Actions) of the Report as follows:. "77?e analytical results for the sample/duplicate pair (TW 4-6/TW 4-70) was outside the 20% RPD acceptance limits. Fifteen of the 27 chloroform program samples collected in November 2011, including TW4-6, were not analyzed within the required holding times for VOCs. Tlie remainder of the 27 samples, including TW4-70 (the duplicate for TW4- 6), were analyzed within the required holding time required for VOCs. Fifteen samples were re-collected and analyzed in December 2011. Comparison of the re-sampled December 2011 TW4-6parent with the original November 2011 TW4-70 duplicate sample for the duplicate pair, resulted in an RPD outside the 20%j acceptance limits As mentioned above, during the fourth quarter chloroform monitoring, the parent sample, TW 4-6, for the TW 4-6/TW 4-70 duplicate pair was re-sampled and reanalyzed to meet holding time requirements, while the duplicate itself, TIV4-70, did not require resampling. Typically, when the laboratoiy has missed holding times or had other QC issues requiring re-sampling, both the sample and duplicate have been affected by the QC issue and both required resampling. In the current case, only the parent sample required re-collection and, as a result, the prime and duplicate sample results for VOCs compared by RPD were not contemporaneous samples. The original and duplicate results for chlonde and nitrate, both Page 3 from the November 2011 sampling (that is, from contemporaneous prime and duplicate samples), did produce RPDs withm acceptable limits. Denison has determined that for future scenarios involving resampling for one or more analyses, sampling personnel will collect one or more duplicate samples during the resampling effort, to ensure that analysis of prime samples and duplicate samples are pel fonned on contemporaneous samples. The QC manager has instructed the sampling personnel to follow this revised practice, if resampling is required, beginning with the first quarter of 2012. " DRC staff accepts DUSA corrective actions and recommends that no notice of violation be issued but, instead issue DUSA a Notice of Enforcement Discretion letter (hereafter "NOED") excepting their corrective actions. Also, in the NOED inform DUSA that the higher chloroform concentration between TW4-6 (21 |Ag/l) and TW4-70 (50 )ig/l) will be used for compliance purposes. Failure to Sample New Well TW4-27 On September 22, 2011 DRC conditionally approved (DRC 2011) for DUSA's plan of action and work schedule identified as "Plan of Action and Work Schedule Revision 1 for the Installation of One of More Monitoring Wells Downgradient of TW4-4 and TW4-6" (hereafter "Plan") [DUSA October 2011]. hi a letter dated November 28, 2011 DUSA stated that the new well, TW4-27, as a resuh ofthis Plan was installed on October 18, 2011 (DUSA November 2011). In condition 2(b) of this Plan it states in Part concerning the TW4-27: "2(b) Quarterly water level measurements and sampling will commence during the ne.xt regularly scheduled chloroform sampling campaign after installation ofthe well. " The Report documents that the 4"^ quarter chloroform monitoring event occurred between November 14 and December 7, 2011 and the new well TW4-27 was not sampled. As stated above, TW4-27 was installed on October 18, 2011. Therefore, DUSA is in violafion of condition 2(b) ofthe Plan. Enforcement action for this violation will be taken through the Plan and not the QAP or Pemiit.
