SUBJECT: May 28, 2010 White Mesa Mill Discharge Minimization Technology (DMT)
Performance Standard Monitoring Report, and Cell 4A BAT Perfonnance
Standards Monitoring Report for the 1^' Quarter, 2010, Submitted as a Single
Volume; April 7, 2009 DRC NOTICE OF NONCOMPLIANCE [NONC]; Future
DMT Compliance Determination and Report Approval
We received the subject DMT and Cell 4A BAT Reports for the 4th Quarter, 2009, dated May 28,
2010. These two reports were submitted as a single bound volume, as well as an electronic copy
on compact disk. We have reviewed this information, and note the following:
1. The subject volume contains a graphical summary of the Cell 2 slimes drain monthly head
measurement tests (>90 hour fluid recovery). The graph shows the monthly data since
January 2009. It appears the previous items of concemed raised in the subject DRC letter
of April 7, 2009 are in compliance in the subject report, with respect to the ground water
discharge permit.
2. The report notes on Table 1 that the interim freeboard limit for Cell 3, established at
5,602.5 famsl by DRC letter dated November 20, 2008, was exceeded on a few occasions.
It appears the Executive Secretary was provided a Notice of these exceedances by two
separate DUSA letters dated March 3, 2010 and March 31, 2010.
3. As you are aware as required by the Part I.D.3.b.l of the permit, "the Permittee shall at all
times maintain the average wastewater head in the slimes drain access pipe to be as low as
reasonably achievable in each tailings disposal cell, in accordance with a DMT Monitoring
Plan. Compliance shall be achieved when the average annual wastewater recovery
elevation in the slimes drain access pipe, determined pursuant to the currently approved
DMT Monitoring Plan, meets the conditions in Equation 1 . . ." We note that pursuant to

Part I.D.3(b) of the upcoming Ground Water Discharge Permit modification, that Cell 2
compliance in this matter will be determined after submittal of the 4"^ Quarter, 2010 DMT
Monitoring Report.
This quarterly report is hereby approved. The verbiage report body appears to be very accurate
in reflecting the tabulated data and other records contained in the report. We appreciate this
