RE: Semi-Annual EffluentMonitoringReport for the period July 1, 2009 through December 31,
2009, DRC Inspection Module EM~01, RML UT1900479.
Dear Ms. Tischler,
An inspeclion was peifonned ofthe Semi-Annual Effiueni Monitoring Repon for the White Mesa Mill
in Blanding, Utah by representatives of the Division of Radiation Control (DRC). The inspection was
an examination of thfe effluent monitoring conducted at your facility as it relates to compliance with
the Utah Radiation Control Rules and the condidons of the license. The inspection consisted of
exanrination of the Semi-Annual Effluent Monitoring Report for the period July 1, 2009 through
December 31, 2009.
During this inspection, several items reviewed were found not to be conducted in compliance with
the Utah Radiation Control Rules and requirements for this license.
Section 5, Stack Sampling, ofthe Report states: "Due to the inadvertence on the part of the Mill's
sampling contractor, the Mill's contract analytical laboratory was not instructed to analyze for Th-
230, Ra-226 or Pb-2l0 for the fourth quarter 2009 sampling event for the yellowcake dryer and
the yellowcake baghouse. However, the laboratory was instructed on February 25, 2010 to analyze
for those constituents from 4*^ quarter 2009 samples remaining at the laboratory, and will be able
to provide Denison with sample results within four to six weeks. Those 4*^ quarter 2009 sample
results will be included in the Semi-Annual Effuent Report for January to June 2010. It should be
noted that, although these 4'^ quarter results are not reported in this Repori, they were taken during
the 4'*^ quarter and will be analyzed and sampled."
Due to these circumstances, the Mill failed to meet the requirements of the Mill's 1991 License
Renewal Application, Appendix E, Section 1.4, Source Emissions, Sub-section 5.1, Yellow Cake
Stacks, which states: "The exhaust stack for the drying and packaging.equipment associated with
the yellow cake calciner is sampled on a quarteriy basis during operations Samples are
analyzed for: Natural Uranium, Lead-210, Radium-226 and Thorium-230 on a quartedy basis."
Contrary to this requirement, samples were not analyzed for Lead-210, Radium-226 and Thorium-
230 for the 3"* or the 4'^ quarters of 2009.

The Report also states that the 4"" quarter samples will be re-analyzed but fails to address the 3'
quarter sample analysis.
Enforcement discretion in this matter will be exercised provided the results for these samples are
received by the DRC in a timely manner. The Report states that sample results will be received by
Denison four to six weeks from February 25, 2010. This would fall sometime between March 25
and April 8, 2010. In order to close the inspection, the DRC requests that Denison submit an
addendum to the Report, including the results of the 3'^ quarter samples, by April 30, 2010.
Please continue to remember that compliance with these requirements as well as all aspects of
radiation safety is the responsibility of the licensee. Thank you for your cooperation in this matter.
