Subject: Denison Mines: Cell 4B Environmental Report - URS Round 1 Interrogatory, Provisional
Harold,
The purpose of this email is to document our discussion this morning about how the DRC will change how we get the URS
interrogatories for the Cel! 4B Environmental Report (ER) to DUSA.
Previously, URS has prepared draft intemagatories for the DRC to review, and after the DRC has found them satisfactory, we have
forwarded them onto DUSA for your consideration and response. Regrettably, the DRC has experienced some delay in recent
review of the ER draft Round 1 Interrogatory due to competing priorities. We recognize the time sensitive nature of the approval
process and Denison's need to construct Cell 4B next year. In order help make this possible, the DRC is now willing to modify the
process of how we get the URS interrogatories to DUSA. Essentially, this will involve the following steps and understanding by all 3
parties:
1. URS will prepare the interrogatory documents and send them to DRC staff,
2. DRC staff will then (withing 24-hours) pass them along to DUSA for consideration, without any examination or review of the URS
woric product,
3. DUSA will examine the interrogatory, identify those issues that can be wori<ed on immediately, and task the appropriate staff,
4. If there are any items in the interrogatory that DUSA does not understand or believes are inappropriate or inapplicable, DUSA
will ask the DRC for a conference call to discuss them. To assist the DRC to prepare for the conference call, DUSA will provide an
email to outiine the Issues at hand.
5. The conference call will provide an opportunity to answer questions and hear concems. In any matters of dispute about the
applicability or appropriateness of an interrogatory item, ttie DRC will act as a "referee" beUveen DUSA and URS. The DRC may ask
URS staff to participate In said conference calls. In deciding an Item of concern, the DRC will work to provide a decision to DUSA in
an expeditious manner. In the event that DRC staff need additional time to consider and decide a matter in dispute, the DRC will
respond to DUSA as quickly as possible after the conference call.
6. All correspondence, induding URS interrogatories and DUSA responses will be matters of record.
7. Both DRC and DUSA recognize that because there is no DRC evaluation or review of the URS work product before it goes to
DUSA, that there is a risk that some issues or concerns could surface in later rounds of interrogatory, that would otherwise have
been presented earlier.
8. In cases where certain Interrogatory issues can be answered or resolved fully by reference to existing work, DUSA will provide
clear and explicit reference to said documents and explain why it is resolves the issue.
9. In subsequent rounds of interrogatory, URS will clearly identify all the resolved issues from Uie previous round. Generally this
will be done by accepting the DUSA response(s). In cases where an issue has been unresolved, URS will re-iterate the interrogatory
in the following round of questions.
