Dear Mr Frydenlund,
Pursuant to the RML, Energy Fuels Resources (USA) Inc (EFR) submitted to the Division of
Radiation Control (DRC) the annual surety estimate on March 2, 2012 and a revised estimate on
September 14, 2012 The DRC has reviewed the submittals and approves the surety amount of
$20,300,614.00 This is an increase of $880,279 00 fi-om the cunently funded $19,420,335 00
Confirmatory Action ,
In a letter dated September 25, 2012, EFR committed to increase the Contingency line item in the
Surety from 15% to 20% of direct costs starting with the 2013 surety submittal (due May 4, 2013),
and to 25% of direct costs in the 2014 surety submittal (due May 4, 2014) EFR committed to
these increases to answer DRC concems over conditions both unknown, and incompletely
quantified at this time Specific examples of poorly quantified conditions identified include known
ground water contaminant plumes and what it will take to remediate the local aquifer EFR
stipulated an understanding, with which the DRC concurs, that all facilities with similar
circumstances will receive similar treatment in the establishment of surety accounts for their
facilities
