SUBJECT: April 19, 2011 DUSA Letter Response to DRC Letter of March 17, 2011; November 15,
IQiQ Annual Technical Evahiation of the White Mesa Mill Tailings Managenient
[The Annual Technical Evaluation Report (ATER)]; Request for Information No. 2
We received and have reviewed the subject DUSA response letter dated April 19. 2011, The response
from DUSA appears to be compiete, except for the DUSAfesponse to comment no, 2 in our letter dated
March 17,2011,
Regarding that comment, in the April 19, 2011 letter, you stated that "the tree-like plants on the Cell 2
interim cover have been removed." However, the photos supplied by DUSA to document the removal
process and results are illegible. They cannot be used to verify our request in our March 17, 2011 letter
that "the tree-like plants growing on the interim cover mustbe removed, and associated damage to the
interim cover on Cell 2 repaired." Though we have also received photographs from a DRC inspector last
week, these photos show tree-like plants still exist on Cell 2. Please explain and justify why the April 19,
2011 statement, that the trees had been removed, was not a false statement.
Please review the above, and respond in writing, by furnishing legible photographs arid documentation that
these trees have been removed. We also request this evidence be submitted as an amendment to the subject
ATER. In an email sent to you on May 17, 2011, regarding this documentation, you agreed to respond to
this letter within 30 days of receipt. Please contact me if you have any questions.
