The Utah Division of Radiation Control (DRC) has completed the review of the 2009 and 2010 Annual
Wastewater Samphng Reports
The review was based on compliance with the Ground Water Quality Discharge Permit Number
UGW370004 (Permit) and the tailings and slimes Drain Sampling Program (Plan) Based on the review it
was found that DUSA failed to meet the minimum detection limit for mercury m the Cell 2 slimes dram
Cell 3 tailings wastewater Cell 4A tailings wastewater and the Cell 2 slimes dram duplicate sample
However the Executive Secretary accepts the DUSA Plan in Section 3 3 5 of the 2010 Annual Wastewater
Sampling Report to resolve this non compliance and there will be no enforcement action
The remainder of the items reviewed were found to be conducted in compliance with the Permit and Plan
This letter constitutes a closeout ofthe 2009 and 2010 Annual Wastewater Sampling Reports
