Time to Submit the Nitrate Corrective Action Plan Phase I Surety Estimate,
Stipulated Consent Order Docket No UGW12-04 DRC Approval
Dear Ms Tischler: DRC.2013-001156
This IS in response to your e-mail request dated January 24, 2013 (4.05 P.M ) Your e-mail
requests an extension of time for Energy Fuels Resources (USA) Inc ("EFR") to submit a revised
surety cost estimate. As you are aware, the surety due date is required by Stipulation and Consent
Order Docket No UGW12-04 ('SCO") Item Ell. Per Item E 11 , the revised surety cost
estimate is reqmred to be submitted by EFR for Director Review and Approval on or before 60
calendar days from the effective date of the SCO. The SCO was signed on December 12,2012,
therefore, the revised surety cost estunate is currently due on or before February 9,2013.
Your extension request is based on time needed by EFR to conduct; "o/ze to three additional rows
of samples, as well as at least six additional samples to assist in bounding the contamination''' at
the ammoma sulfate crystal tanks m order to produce a surety cost estimate for the Phase I
excavation volume. Per a teleconference between you and DRC staff on January 23,2013, you
stated that the ongmal three rows of soil bonngs/samples failed to delmeate the plume boundary
(values at the outermost samples exceed 2 times background concentrations for ammoma and/or
mtrate).
Based on the January 23, 2013 teleconference and your January 24,2013 e-mail request, the
extension of time is approved for an additional 60 calendar days from the onginal deadlme
specified in the SCO Part E.l 1. The revised surety cost estimate is due on or before Apnl 10,

Also, please be aware that per the SCO Part E 6 , all Phase I analytical data is required to be
submitted to the Director withm 60 days of EFR receipt of all the Phase I soil samphng data
results.
