Re: Warning Letter – Staker Parson Companies – McGuire Pit, Utah Administrative Code
(UAC) R307-401, Approval Order (AO) DAQE-AN100420011-21, Box Elder County

On June 2, 2023, a representative of the Utah Division of Air Quality (DAQ) conducted a full
compliance inspection of Staker Parson Companies McGuire Pit. The DAQ noted the replacement of
permitted equipment listed in the AO which may be in violation of UAC R307-401-11 and Condition
I.3 of the AO for the failure to submit a Replacement-in-Kind notification prior to replacing
equipment.

Please be aware this letter is a warning and that future instances of noncompliance may be considered
violations of UAC R307-401-11 and Condition I.3 of the AO and Staker Parson Companies may be
assessed penalties up to $10,000 per day if found to be in violation of Utah Air Quality Rules.
