APPENDIX I.H - Storm Water Discharges Associated with Industrial Activity from Coal Mines and Coal Mining-Related Facilities
Coverage of This Section.
Discharges Covered Under This Section. The requirements listed under this Part shall apply to storm water discharges from the following activities:

Sector Specific Limitations on Coverage. In addition to the limitations on coverage listed in Part I.C, the following storm water discharges associated with industrial activity are not
authorized by this permit:
Discharges subject to an existing effluent limitation guideline in 40 CFR Part 434; and
Storm water discharges from inactive mining activities occurring on Federal lands where an operator cannot be identified; and
Storm water discharges from earth-disturbing activities conducted prior to active mining activities. These are considered construction activities and must be covered under the Construction
General Permit.
Discharges comprised of more than stormwater are not covered by this permit and the permittee may be required to obtain coverage under the Utah Coal Mine General Permit (UTG040000) or
another UPDES permit.
Sector Specific Prohibition of Non-Stormwater Discharges. In addition to those non-storm water discharges prohibited under Part I.D, this permit does not authorize the discharge of:
Discharges from pollutant seeps or underground drainage from inactive coal mines and refuse disposal areas that do not result from precipitation events; and
Discharges from floor drains in maintenance buildings and other similar drains in mining and preparation plant areas.
Sector Specific Control Measures and Effluent Limits.
In addition to the control measures and effluent limits in Part III, the permittee shall implement the following to minimize pollutant discharges, as applicable:
Good Housekeeping. Good housekeeping measures, such as the following, shall be used to minimize potential sources of pollutants in stormwater at the facility:
Using sweepers and covered storage;
Watering haul roads to minimize dust generation; and
Conserving vegetation to minimize erosion.
Maintenance of Control Measures. The permittee shall maintain all control measures, equipment, and systems used to maintain compliance with this permit by implementing maintenance of
control measures practices, such as the following, where feasible:
Removal and proper disposal of settled solids in catch basins to allow sufficient retention capacity;
Periodic replacement of siltation control measures subject to deterioration such as straw bales; and
Performing inspections or other equivalent measures of storage tanks and pressure lines of fuels, lubricants, hydraulic fluid, and slurry to prevent leaks due to deterioration or faulty
connections.
Dewatering Practices. In addition to the control measures identified in Part III, the permittee shall meet the following requirements for dewatering activities, if conducted, where applicable:
The discharge is composed entirely of stormwater or uncontaminated ground water seepage from mining facilities;
There are no visible floating solids or foam;
All oil, grease and other pollutants have been removed, if observed, from dewatering water via an oil-water separator or suitable filtration device;
Vegetated upland areas of the site are utilized, to the extent feasible, to infiltrate dewatering water before discharge. In no case shall waters of the state be considered part of the
treatment area;
There have been velocity dissipation devices implemented at all points where dewatering water is discharged; and
All backwash water has been hauled away for disposal or returned to the beginning of the treatment process.
Sector Specific Inspection Requirements.
In addition to the inspection requirements in Part IV.A, the permittee shall also inspect the following activities, if they take place at the facility:
Active Mining Related Areas. Inspections by the qualified personnel may be done at the same time as the mandatory inspections performed by SMCRA inspectors. Records of permittee inspections
and those of the SMCRA authority representative shall meet the requirements in Part IV.A.3 and be maintained with the Plan in an accessible format.
Sector Specific Plan Requirements.
Other Applicable Regulations. Most of the active coal mining-related areas, described in Part A of Appendix I.H, are subject to sediment and erosion control regulations of the United
States Office of Surface Mining (OSM) that enforces the Surface Mining Control and Reclamation Act (SMCRA). OSM has granted authority to the Utah Division of Oil Gas and Mining (DOGM)
to implement SMCRA through State SMCRA regulations. All SMCRA requirements regarding control of erosion, siltation, and other pollutants resulting from storm water runoff, including
road dust resulting from erosion, shall be included of the pollution prevention plan and shall be included in Part VII.D of the Plan directly, or by reference. Where determined to be
appropriate for protection of water quality, additional sedimentation and erosion controls may be warranted.
Site Map. In addition to the requirements in Part VII.D.3, the site map shall also include the location of the following, if applicable:
Access and haul roads;
Railroad spurs, sliding, and internal hauling lines;
Conveyor belts, chutes, and aerial tramways;
Coal handling buildings and structures;
Inactive mines and related areas;
Acidic spoil, refuse, or unreclaimed disturbed areas; and
Liquid storage tanks containing pollutants such as caustics, hydraulic fluids, and lubricants.
Summary of Potential Pollutant Sources. In addition to the requirements in Part VII.D.4, the Plan summary of potential pollutant sources inventory shall also include the following, as
applicable:
Truck traffic on haul roads and resulting generation of dust or sediment that could be discharged via stormwater;

Fuel or other liquid storage;
Pressure lines containing slurry, hydraulic fluid, or other potential harmful liquids; and
Loading or temporary storage of acidic refuse or spoil.
Monitoring Requirements.
Analytical Benchmark Monitoring. The following analytical benchmark monitoring parameters shall apply specifically to sector H facilities. Parameters found in this Part apply to both
primary industrial activities and any co-located industrial activities.

Sampling for TSS is not required for storm water discharges that are infiltrating to groundwater.
Numeric Effluent Limitation Monitoring. There are no numeric effluent limitation parameters for Sector H facilities in this permit. Any additional monitoring and reporting requirements
shall be based on the nature of activities at the facility and the facility stormwater discharges, in accordance with Part V.D.2.
